Sri Devki Nandan Singh And Another vs Sri Rishi Kumar Jain And 2 Others on 11 March, 2026

1. Heard learned counsel for the parties and perused the record.

2. This petition has been filed challenging the order dated 22.03.2024 by which the civil revision filed by the defendant/respondent has been allowed against an order of injunction passed by the trial court in exercise of powers under Section 151 C.P.C.

3. It is admitted to counsels for both the parties that application for interim injunction (paper No. 6C) is pending.

4. Since the application for interim injunction is pending, no useful purpose would be served in keeping this petition pending.

5. Accordingly, the present petition stands disposed of finally with a direction to the Civil Judge (S.D.) Etah to consider and decide the aforesaid interim injunction application, in accordance with law, expeditiously, preferably within a period of four weeks from the date of production of a certified copy of this order after ensuring service upon all the concerned parties as well as giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment and without being influenced by the findings recorded by the revisional court.
