The Private Complaint is filed by the Complainant under
Section 200 of Cr.P.C. against the accused alleging that he has
committed the offence punishable under Section 138 of
Negotiable Instruments Act.
2. The brief facts of the complaint are as follows:
The complainant submits that the Accused introduced to
him by his close relative. The Accused approached him in the
1st week of December 2015 and requested for a handloan of
Rs.17 lakhs to meet his domestic financial necessities. By
considering the relationship, the Complainant paid a handloan
of Rs.17 lakhs to the Accused on 28.12.2015. The Complainant
by withdrawing Rs.14 lakhs from his SB account and
remaining amount was in his house and paid the same to the
Accused. The Accused has promised to repay the said amount
along with interest @ 18% per annum within 8 years.
