                                         ORDER

10.03.2026

[1] Present Mr. Th. Henba, learned counsel on behalf of the petitioner
as legal aid counsel and Mr. Y. Ashang, learned PP assisted by Mrs. RK. Emily,
learned Dy. GA for the State respondents.

[2] On the recommendation of the Under Trial Review Committee
(UTRC), the petitioner, who is an accused in FIR No. 31(5) MRG P.S. u/s 302 IPC
r/w 201 IPC, was directed to be released on bail on furnishing PR Bond of
Rs.50,000/- (Rupees fifty thousand) only and a surety bond of like amount by
the Ld. Chief Judicial Magistrate, Bishnupur, vide order dated 21.12.2020. Since
the petitioner was not able to furnish the requisite bond, he then approached
the Ld. Sessions Judge, Bishnupur and vide order dated 02.08.2023, the PR bond
amount was reduced to Rs. 25,000/- (Rupees twenty five thousand) only and
with one surety of like amount.

[3] By the present petition, the petitioner prayed for to exempt the
petitioner from furnishing surety bond or to allow the petitioner to furnish surety
bond or to deposit bond amount in cash within a stipulated period of time after
the petitioner is released on bail from the jail. It is submitted that the petitioner
is an accused for allegedly murder of his wife and his son is the complainant in
this case. Even if, he is released on bail, it may not be possible him to stay with
his own family members. In the circumstances, the learned counsel for the
petitioner submits that some time may be given to arrange alternate residence
for the petitioner through legal aid.

[4] Mr. Y. Ashang, learned PP for the State respondents submits that
the petitioner is involved in heinous crime and exempting altogether bail bond
may not be appropriate.

[5] However, considering the fact that the petitioner age is about 75
years old, the learned counsel for the petitioner is given some time to make
alternative residence of the petitioner, if he is to be released on bail.

[6] List this case on 18.04.2026.

[7] Furnish a copy of this order to the learned counsel appearing for
the petitioner.

                                                           JUDGE
