01. This case is registered U/sec. 200 of
Cr.P.C based on the written complaint given by the
complainant against the accused for the offence
punishable under Section 138 of Negotiable
CC.NO.31960/2022

Instrument Act, 1881 (hereinafter called as NI Act
for the purpose of brevity).
02. The case of the complainant in brief is as
under :-
The accused has obtained hand loan of
Rs.1,25,000/- from the complainant and agreed
to refund the same within one month. Since the
accused failed to repay the loan amount upon
insistence, the accused has issued cheque bearing
No.076401 dated: 13.06.2022 for sum of
Rs.62,500/- and another cheque bearing
No.076400 dated: 18.08.2022 for sum of
Rs.62,500/- both cheques are drawn on Axis
Bank, New BEL Road, Bengaluru. As per
instruction of the accused, the complainant
presented the said cheques for encashment
through his Banker and it was dishonoured on
04.08.2022 and 19.08.2022 with an endorsement

as “Funds Insufficient” and ” Payment Stopped”
