This revisional application has been filed under Section
482 read with Section 401 of the Code of Criminal Procedure,
1973 for quashing of the proceeding pending before the Learned
Chief Metropolitan Magistrate, Kolkata in connection with
Shakespeare Sarani, P.S. Case No.179 of 2013 dated 21.4.2013
filed by the petitioner arising out of G.R. Case No.1552 of 2013.
2. The brief fact of the case is that the opposite party no.3 is
a company having its head office at Kolkata and was engaged in
the manufacturing of Foam and Mattress from Jaipur.
3. The petitioner approached the opposite party no.3 for
getting job as a ‘Company Secretary’ and she joined as a
Company Secretary on 22.01.2009 on the terms and conditions
stipulated in the letter of appointment. Her probation period was
for a period of six months with an initial salary of Rs.16, 625/-
per month in addition to the other benefits, as contained in the
said letter. On completion of probation period successfully on
July 21, 2009, her service was confirmed with effect from the
date of appointment vide a letter issued by the opposite party
no.3. Subsequently, after being satisfied to the performance of
petitioner and her sincerity and integrity, the pay scale of the
petitioner was revised by the opposite party no.3 with effect from
1.12.2010 and she withdrew her last salary for the month of
May, 2012.
