The Division Bench of the High Court of Sikkim on December 13, 2024, set aside the earlier Order passed on September 12, 2023, by the Single Judge, with a direction to the concerned authority to adjudicate the claims of Zydus Wellness Products Limited after affording Zydus Wellness Products an opportunity of hearing within 12 (twelve) weeks from the date of the Order.
The High Court pronounced the judgment on September 12, 2023, dismissing the Writ Petition against Wellness Products Limited and in favour of the Union of India.
Zydus Wellness Products Limited filed a Writ Petition against the Union of India and Others in the High Court of Sikkim in the matter of arbitrarily and unilaterally denying the budgetary support upon conversion of Zydus Wellness into Zydus Wellness Products, under the Scheme of budgetary support in Goods and Service Tax Regime issued by the Department of Industrial Policy and Promotion, The Ministry of Commerce and Industry in 2017.
