[1] This order will now dispose of the captioned matrimonial

appeal.

[2] Huirem Jayenta Singh and Aheibam Ibeyaima Devi

(appellants in captioned appeal) were married, their marriage was

solemnized on 31.11.2018 but there was marital discord and they jointly

approached the jurisdictional Family Court i.e. ‘Family Court, Manipur at

Lamphelpat, Imphal’ (‘said Family Court’ for the sake of convenience)

for dissolving their marriage by mutual consent inter alia vide Section

13 B of ‘the Hindu Marriage Act, 1955‘ (‘said Act’ for the sake of brevity).

[3] To be noted, as it is an application for divorce by mutual

consent, same counsel, i.e., Mr. Naoroibam Alex Singh represents both

parties. The said Family Court rejected the joint plea for waiver of

cooling period vide Section 13 B of said Act by way of an order dated

11.08.2025 and captioned statutory appeal under Section 19 of ‘the

Family Courts Act 1984′ (‘Family Courts Act‘ for the sake of convenience)

has been filed by both individuals assailing the 11.08.2025 order of the

said Family Court.

[4] In and vide order dated 19.09.2025, this Court referred

the parties to mediation and after mediation sittings, the mediation

report is before this Court.

[5] The mediation report is dated 06.10.2025 and a careful

perusal of mediation report brings to light that the parties have arrived

at a settlement and the terms of settlement have been reduced to

writing on 06.10.2025. The cover letter from the High Court Legal

Services Committee dated 08.10.2025 and the Mediation Report

containing the terms of settlement agreement signed by both parties

have been placed before this Court and a scanned reproduction of the

same are as follows:

[6] Mr. Naoroibam Alex Singh, learned counsel representing

both parties, submits that both parties signed the afore-referred terms

of settlement in the presence of one another and requests for disposal

of captioned appeal in terms of the afore-referred terms of settlement

agreement dated 06.10.2025. This request is acceded to.

[7] Captioned matrimonial appeal is disposed of in terms of

the afore-referred terms of settlement agreement dated 06.10.2025

which shall now form part of this order.

[8] Captioned matrimonial appeal disposed of as closed sin

the aforesaid manner. There shall be no order as to costs.
