Heard the parties.

2. This is the 3rd attempt of the petitioner for grant

of regular bail in connection with Sessions Case No. 1025 of

2023 arising out of Bhadwar P.S. Case No. 24 of 2022. Earlier

the bail applications of the petitioner was rejected vide orders

dated 20.09.2023 and 11.09.2024 passed in Cr. Misc. No. 48411

of 2023 and Cr. Misc. No. 64651 of 2024 respectively. The

order dated 11.09.2024 reads as under:-

Heard learned counsel for the petitioner
and learned APP for the State.

2. The petitioner seeks bail in connection
with Bhadwar P.S. Case No. 24 of 2022 registered for
the offence punishable under Sections 307, 353, 341,
323, 121, 124A, 216/34 of the Indian Penal Code and
under Sections 25(1-AA), 26, 35 of the Arms Act and
Patna High Court CR. MISC. No.92012 of 2025(2) dt.12-02-2026

under Section 13, 16, 17, 18, 19, 20, 38, 39 of
Unlawful Activities (Prevention) Act.

3. As per the prosecution case, the petitioner
was caught with one AK-56, some cartridges and cash
of Rs. 40,000/-.

4. The petitioner is a hardcore Naxal and he
is accused in two more cases under UAP Act.

5. The petitioner is in custody since
23.07.2022.

6. Earlier the prayer for regular bail of the
petitioner was rejected vide order dated 20.9.2023
passed in Cr. Misc. No. 48411 of 2023 by a co-ordinate
Bench of this Court.

7. Considering the aforesaid facts and also
considering the fact that the petitioner is a hardcore
Naxal, this Court is not inclined to enlarge the
petitioner on bail.

8. Accordingly, this application stands
dismissed.

3. It has very fairly been submitted by the learned

counsel for the petitioner that the charge has already been

framed in this case.

4. In view of the fact that the trial is progressing and

the considering the gravity of the offence, this Court finds no

new ground to review its earlier order.

5. Accordingly, this application is dismissed.

6. The Senior Superintendent of Police, Gaya is

directed to ensure the attendance of the witnesses in the trial.

7. Let a copy of this order be communicated to the

Senior Superintendent of Police, Gaya through FAX for its
