The Criminal Petition has been filed under Section 482 of the Code of

Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’)/Section 528 of the

Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to

quash proceedings against petitioners/Accused Nos.1 & 2 in Cr.No.248 of

2025 on the file of the Kanigiri Police Station, Prakasam District, registered for

the alleged offence punishable under Sections 420, 506 read with 34 of the

Indian Penal Code, 1860 (for brevity ‘the IPC’).

2. Heard the learned counsel for the petitioners and the learned Assistant

Public Prosecutor. Perused the record.

3. As seen from the record, the grievance of Respondent No.2 is that the

petitioners showed the immovable property under one survey number but sold

the immovable property under another survey number. This transaction

occurred in the year 2021. Respondent No.2 lodged a complaint on

21.07.2025, nearly four years later. The nature of the transaction between the

petitioners and Respondent No.2 is, by and large, civil in nature. The said

complaint was registered as Crime No.248 of 2025 on the file of Kanigiri

Police Station, Prakasam District, for the alleged offences punishable under

Sections 420 and 506 read with Section 34 of ‘the IPC’. All the offences

alleged against the petitioners/Accused Nos.1 and 2 are punishable with

imprisonment for less than seven years.
