We have heard the learned counsel appearing for

the parties.

SPONSORED

This Transfer Petition has been filed by the

petitioner-wife under Section 25 of the Code of

Civil Procedure, 1908 seeking transfer of divorce

petition bearing HMA No. 2149/2024 titled ‘Vipul

Suri Vs. Sanya Suri’ pending before the Court of

Principal Judge, Family Court, Faridabad, Haryana to

the Court of the Principal Judge, Family Court,

South East, Saket Court, New Delhi.

The IA No.82465/2026 which is the joint

application filed by the parties seeking grant of

divorce by mutual consent under Article 142 of the

Constitution of India, 1950 is taken on record.

It is submitted that pursuant to the mediation

Reason: Centre, the parties have entered into a Settlement

Agreement dated 20.01.2026. The Settlement

Agreement, duly signed by the parties and their

respective counsel, has been filed by the parties

and the same is taken on record.

According to the Settlement Agreement, the

parties have settled their disputes and have agreed

to abide by the terms of the aforesaid Settlement.

As per the Settlement Agreement, the following cases

are pending inter se the parties:

“(i) Petitioner/wife has filed Mt. Case 31/2025

U/Sec.144 of BNSS, 2023 for maintenance, titled

as Sanya Suri vs Vipul Suri pending before Ms.

Namrata Aggarwal, Ld Family Judge, Family

Courts, Saket Court Complex, New Delhi;

(ii) Petitioner/wife has lodged FIR

No.0500/2025 at Police Station Sarita Vihar,

U/Sec.406/498A/34 IPC against

Respondent/Husband and his family members.

(iii) Respondent/Husband has filed divorce

petition No.2149/2024 under Section 13(1)(i-a)

of Hindu Marriage Act, titled Vipul Suri vs

Sanya Suri before Shri Vijay James, Addl

Principal Judge, Family Court, Faridabad,

Haryana.”

The above-mentioned cases at (i), (ii) and (iii)

shall stand closed, in view of the Settlement

Agreement. The parties further agree that they will

have no claims or rights against each other or their

respective family members in the future. The parties

also affirm that they have no further claims or

demands against each other or any movable or immovable

property and all the disputes and differences have

been amicably settled by them through the process of

mediation.

Learned counsel appearing for the parties further

pray that in view of the Settlement Agreement, this

Court may allow the joint application filed by the

parties and invoke its jurisdiction under Article 142

of the Constitution of India, 1950 to pass a decree of

divorce by mutual consent.

Accordingly, by invoking our jurisdiction under

Article 142 of the Constitution of India, 1950, the

marriage between the parties stands dissolved in terms

of the Settlement Agreement. The divorce decree shall

be drawn up accordingly and the Settlement Agreement

shall form part and parcel of this order.

We also place on record the statement made by the

learned counsel appearing for the parties that the

last payment as agreed upon in the Settlement

Agreement has been made.

The Transfer Petition stands disposed of in the

aforesaid terms.

Pending application(s), if any, shall also stand

disposed of.
