This Request Petition has been filed by the petitioner

under Section 11(6) of the Arbitration and Conciliation Act,

1996 with a prayer for appointment of Arbitrator to resolve the

dispute between the parties which has arisen on account of

property dispute.

2. The learned counsel for the petitioner fairly submits

that since there is no arbitration clause and there is also no

arrangement between the parties that the dispute is to be

resolved by the arbitrator, he seeks liberty to withdraw the

petition to seek appropriate remedy in accordance with law.

3. Liberty, as prayed for, is granted to the petitioner.

4. Accordingly, the petition is disposed of as

withdrawn.
