 Court No. - 5

 HON'BLE KSHITIJ SHAILENDRA, J.

1. This petition has been filed challenging the order dated 11.07.2023, whereby learned Civil Judge (Senior Division), Allahabad has granted an ad-interim status quo in Original Suit No. 504 of 2023.

2. The petition is reported to be beyond time by 855 days.

3. Explaining the laches, learned counsel for the petitioners submits that after the aforesaid order was passed, the petitioners also filed their own Suit No. 660 of 2023 in which an ad-interim status quo has been passed on 21.08.2023 in respect of the same property. He further submits that in separate proceedings arising from Board of Revenue, this Court in Writ-B No. 1542 of 2025 has passed an order favourable to the petitioners on 07.05.2025 and despite the aforesaid, interference on the spot is being made by the other side.

4. Learned Standing Counsel is present and she submits that the petitioners have unnecessarily impleaded respondents no. 2 to 6, who were not parties to the suit.

5. Learned counsel for the petitioners submits that these authorities have been impleaded in view of a representation filed by the petitioners before them requesting protection of their property.

6. In the opinion of the Court, the petition is thoroughly misconceived. If two ad-interim or injunction orders in the nature of status quo passed in different suits filed by the rival parties are in existence, the parties are always at liberty to file appropriate application before the concerned civil courts in both the suits either for implementation of the orders or for violation thereof.

7. As far as order dated 07.05.2025 passed by this Court in Writ-B No. 1542 of 2025, the same cannot be made subject matter of further petition arising out of orders of status quo passed in civil proceedings.

8. Leaving it open for the petitioners to approach the civil court in the pending suit, no direction can be issued in these proceedings.

9. The petition is, accordingly, dismissed.
