rejected the prayers for bail of the two

appellants, Ram Niwas and Narpatlal,

respectively.

3. Appellants, Ram Niwas and Narpatlal,

figuring as accused in FIR No.10 of 2024 dated

03rd March, 2024 registered at Police Station

SOG, District Jaipur, Rajasthan under Sections

419, 420 & 120-B of the Indian Penal Code,

1860, Sections 4, 5 & 6 of the Rajasthan Public

Examination (Prevention of Unfairmeans) Act,

1992 and Section 66D of the Information

Technology (Amendment) Act, 2008, were

arrested on 10th April, 2025 and 05th April, 2025,

respectively.

4. We have heard learned counsel for the

appellants and the respondent-State of Rajasthan

and perused the materials on record.

5. Similarly placed accused have been granted

the concession of bail pending trial. Interim bail

was granted by this Court to the appellants, Ram

Niwas and Narpatlal, vide order dated 05 th

February, 2026. Such order is made absolute.

6. Accordingly, we set aside the impugned

judgment(s) and order(s).

7. Appellants shall continue to remain on bail

on terms and conditions already fixed by the trial

court. The trial court is also free to impose other

terms and conditions as well.

8. In the event there is any breach of the

terms and conditions for grant of bail, the trial

court shall be at liberty to cancel the bail of the

appellants.

9. It is also ordered that the appellants shall

diligently attend proceedings of the trial, unless

exempted. If they abstain from attending the

proceedings without justifiable cause, that could

also be seen as breach of the conditions for

grant of bail and the trial court will be free to

pass appropriate orders.

10. We clarify that the observations made in

this order and grant of bail will not be treated as

findings on the merits of the case.

11. The appeals are, accordingly, allowed on the

aforesaid terms.

12. Pending application(s), if any, shall stand

disposed of.
