1. Heard Sri Ajeet Kumar Rai, Advocate holding brief of Sri Jay Prakash Singh, learned counsel for the appellants and Sri S.P. Tiwari, learned AGA for the State of U.P. as well as perused the material available on record.

The instant Criminal Appeal under Section 374 (2) Cr.P.C. has been filed by the appellants namely Ram Lakhan s/o Ram Saran, Bhunnu s/o Medai, Jeet Lal s/o Bhunnu and Ram Adhar s/o Bhunnu challenging the judgment and order 26.06.2008 passed by the Additional Sessions Judge/Fast Track Court, Pratapgarh in Session Trial No. 75 of 1996, arising out of Case Crime No. 77 of 1994, under Sections- 323, 504, 506, 436 IPC and Section 3(1)(4) of SC/ST Act, P.S.- Mandhata, District- Pratapgarh, thereby convicting and sentencing the appellants under Section 323/34 IPC for one year’s simple imprisonment, under Section 325/34 and 506 IPC for six months’ rigorous imprisonment.
