Judgment

1. These writ petitions were filed primarily against Rajasthan
Paramedical Council (hereinafter referred as 'RPMC) with almost
identical prayers in each of the petition. The controversy and the
issue raised herein is common and only regard to the course
undertaken by the petitioner(s) from different universities such as
Shri Krishna University Chhatarpur (MP), PK University (MP),
Sardar Patel University, Balaghat (MP), Shri Satya Sai University
of Technology and Medical Sciences, Sehore, (U.P.) and AISECT
University, Raisen (MP) (now known as Rabindranath Tagore
University). Since the issue is common, therefore, we are deciding
all these writ petitions with a common order.
2. These writ petitions are filed with following prayer:-
In SB Civil Writ Petition No. 13864/2023:-
"In these circumstances, it is, therefore, prayed that
this Hon'ble Court may be pleased to accept this
writ petition and
i. the impugned cancelation of registration order
dated 19.07.2023 passed by the Registrar,

Rajasthan Paramedical Council which have been
issued in illegal and arbitrary manner may kindly be
declared illegal and arbitrary and therefore, same
may kindly be quashed and set aside.
ii. by issuing appropriate writ, order or direction
in the nature thereof respondents may kindly be
directed to:
a) to consider the qualification of Degree in
Diploma in X-Ray (Radiographer Technicial)
from Shri Krishna University as valid
qualification for registration with the Rajasthan
Paramedical Council in pursuance to the
advertisement dated 31.05.2023;
b) To restore the registration certificate of the
humble petitioner from the earlier date of
issuance of the registration form;
c) To give appointment and joining to the
humble petitioner on the post of Assistant
Radiographer with all consequential benefits, if
he is otherwise found in merit;
iii. Any other appropriate order or direction which
this Hon'ble Court deems just and proper in the
facts and circumstances of this case may kindly
also be passed in favour of the Petitioner."
In SB Civil Writ Petition No. 12788/2023:-
"In these circumstances, it is, therefore, prayed
that this Hon'ble Court may be pleased to accept
this writ petition and
i) the impugned order dated 27.07.2023 passed by
the appellate authority and the impugned order
dated 05.07.2023 which have been issued in illegal
and arbitrary manner may kindly be declared illegal
and arbitrary and therefore, same may kindly be
quashed and set aside.
ii) by issuing appropriate writ, order or direction in
the nature thereof respondents may kindly be
directed to
a) to consider the qualification of Degree in
Diploma in X-Ray (Radiographer Technician)
from Shri Krishna University as valid

registration certificate to the petitioners.

respondents may kindly be directed : -
a. to consider the qualification of Degree in
Diploma in X-Ray (Radiographer Technician)
from Sardar Patel University as valid
qualification for registration with the Rajasthan
Paramedical Council.
b. to treat the petitioner eligible for
appointment on the post of Assistant

costs and further be pleased to :-

whereby the application filed by the petitioners for
registration with the Rajasthan Paramedical Council
have been rejected as being arbitrary, illegal and

illegal act of the respondents must be deprecated
in strongest terms.
6. Any other relief which this Hon'ble court may
deem fit may be passed in favour of the humble
petitioner in the interest of equity, justice and good
conscience."

3. After conclusion of arguments, learned counsel appearing on
behalf of the RPMC has filed written submissions and in his written
submission, he has apprised about all those candidates, who

after consideration of their representation (supported with
documents), as an appeal by general body of the RPMC under
Section 32 of the Rajasthan Paramedical Council Act, 2008,

been revived. The counsel has candidly admitted that subsequent
to development, the RPMC does not press its reply with regard to
candidates/petitioner(s) who have obtained desired qualification
from Shri Krishna University, Chhatrapur (MP).

5. The brief facts of these cases are that the petitioners after
admission in relevant University for the course as mentioned in
their writ petition, have successfully completed the course and on
basis of diploma certificate, they got registered as para-medical
professional in Madhya Pradesh Paramedical Council (for short
'MPPMC') for practice in State of Madhya Pradesh. The petitioners
wanted to get registered as paramedical professional in the State
of Rajasthan and for registration with the RPMC, the petitioner(s)
got cancelled registration from the MPPMC and obtained a no
objection certificate (NOC) from the Registrar of MPPMC to enable
them to register with the RPMC.
6. Some of the petitioners were registered by RPMC, a body
established under the Rajasthan Paramedical Council Act, 2008
(hereinafter referred as 'the Act of 2008'). The registration of said
petitioner was cancelled later on by RPMC. The petitioners have
challenged the rejection (recall)/non-registration before this Court.
7. The material on record clearly indicates that 27 writ petitions
belong to candidates who passed out from Shri Krishna University,
Chhatarpur (MP), and after registration as paramedical
professionals in Rajasthan, the RPMC has cancelled their
registration but after considering their representation by the
Paramedical Council under Section 32 of the Act of 2008, the
registration certificate(s) of these petitioners were revived.
8. Out of this bunch, 7 petitioners belonged to PK University, 3
belongs to Sardar Patel University, one from Shri Satya Sai
University and one from AISECT University (now known as
Rabindranath Tagore University).

9. Learned Senior Advocate appearing on behalf of the
petitioners submitted that the University was established under
the legislative act of concerned State and the petitioners have
taken admission in a statutory university having due recognition
from UGC. It further submitted that after procuring a diploma
certificate from the University, the petitioners have applied for
registration before MPPMC and on the basis of qualification
recognition by MPPMC, the petitioners were registered as
paramedical professionals in the State of Madhya Pradesh. He
further submitted that since the petitioner(s) want to work in the
State of Rajasthan, therefore, they have got NOC from MPPMC,
after cancellation of their registration certificate and subsequently
applied to the RPMC. He further submitted that the qualification of
each of the petitioner(s) well recognized by MPPMC and for
undertaking a paramedical course in the State of Madhya Pradesh,
the MPPMC is a regulatory body. He further submitted that the
petitioner(s) have proper qualification as per the provision of law
and their qualification cannot be challenged on any of the reasons
as assigned by the Registrar, RPMC.
10. Learned Senior Advocate/counsel further referred judgment
in case of State of Rajasthan Vs. Anil Vishnoi and Ors. :
DBSAW No. 286/2021 passed by a Division Bench of this Court
and judgment in case of Lalit Kishore Vs. State of Rajasthan
and Ors : SB Civil Writ Petition No. 8908/2020 and Sharwan
Ram Badiyasar Vs. State of Rajasthan and Ors. : S.B. Civil
Writ Petition No.17278/2021 and other connected matters
passed by a Co-ordinate bench of this court and submitted that

considering the action of RPMC as arbitrary, this Hon'ble Court has
intervened in said matters and granted relief to the candidates.
11. Learned Senior Advocate/counsel has further referred to the
provision under The Rajasthan Paramedical Council Regulations,
2014, (hereinafter referred to 'the Regulation of 2014'), notified
under the Act of 2008 by the State of Rajasthan, and submitted
that the Regulation 42 prescribed eligibility for registration and
petitioners are possessing eligibility conditions as prescribed
therein. They also referred procedure under Rule 43 for
registration and also Regulation 48 for removal from register and
submitted that the cancellation of registration by the Registrar,
RPMC is not supported from any of the circumstances as
mentioned under Regulation 48.
12. Learned Senior Advocate/counsel further referred judgment
in case of Laxmi Saroj and Ors. Vs. State of Uttar Pradesh
and Others reported as (2022) 17 SCC 477 and submitted that
on the basis of judgment in case of Narender Singh Vs. State of
Haryana reported in (2022) 3 SCC 286, it was held that if there
is no fault of the applicant concerned, then he cannot be punished
for no fault attributable to him. He also referred registration
process of the State of Madhya Pradesh and also of the State of
Rajasthan and submitted that the provision of registration are
same and after the enquiry, the petitioners were registered by the
MPPMC but in Rajasthan, when the petitioner(s) have applied for
registration along with NOC from the MPPMC, a different yardstick
was adopted by the RPMC which is itself discriminatory and
against the equality before law.

13. Learned Senior Advocate/counsel further referred judgment
dated 12.12.2023, passed by of a Co-ordinate Bench of this Court
at Principal Seat, Jodhpur in S.B. Civil Writ Petition
No.9397/2023 (Sunil Vishnoi and others versus State of
Rajasthan and others) and submitted that on the basis of
judgment in cases of Lakshmi Saroj (supra) and Narendra
Singh (Supra), the writ petition was allowed in case, where the
candidates have applied in Rajasthan after obtaining NOC from
MPPMC.
14. Aforesaid contentions were opposed by learned counsel
appearing on behalf of the Department of Medical Health and
other respondents and they submitted that it is the duty of the
petitioner(s) to submit all relevant documents for registration in
accordance with the Regulation of 2014 and Act of 2008 in the
State of Rajasthan, but if the petitioner(s) have failed to submit
relevant documents to establish that they have undertaken a
regular course then the act of the RPMC is not questionable before
this Hon'ble Court by invoking provision under Article 226 of the
Constitution of India.
15. Learned counsel appearing on behalf of the RPMC has
opposed the contentions of the learned Senior Advocate/counsels
appearing on behalf of the petitioners but after conclusion of
argument, the learned counsel for RPMC has submitted a written
submission whereby he has conceded that after verification, the
diploma obtained from Shri Krishna University (certificate for
qualification for registration), was found in accordance with
Regulations, the registration certificate of the petitioner(s) who
passed out from Shri Krishna University, were already revived

pursuant to decision by the full meeting of RPMC. Today, he fairly
submitted at bar that he has no objection in case, 27 writ petitions
filed by the petitioners, who passed from Shri Krishna University
are allowed by this Hon'ble Court.
16. Learned counsel appearing on behalf of the RPMC has further
submitted that 7 candidates have passed from PK University
whereas 3 from Sardar Patel University and both of them have not
submitted sufficient documents to conclude the inquiry by the
RPMC. He further submitted that the course undertaken by said
petitioners, is in accordance with regulation or not has to be
inquired but no documents with regard to recognition of the
course undertaken from the PK University and the Sardar Patel
University were filed on record with RPMC, so it is not possible for
RPMC to conduct a full-fledged inquiry but he submitted that the
RPMC cannot register any candidate unless the course undertaken
by him is recognised under the law. He submitted that the
candidate has an option to file an appeal under Section 32 of Act
2008 and direct invocation of jurisdiction of this Hon'ble Court is
contrary to settled law.
17. Learned counsel for the RPMC further submitted that the
course undertaken from Shri Satya University and AISECT
University (now known as Rabindranath Tagore University) are not
recognised and the RPMC cannot register them under the
regulation of 2014. He further submits that the course undertaken
by the petitioner is required to have regulatory approval before
being commenced by the University concerned, but herein, no
such document is placed along with writ petition, therefore, these
writ petitions are not maintainable.

18. Heard learned Senior Advocate, learned counsels for the
petitioners and learned counsels for the respondents. Perused the
material placed on record, also considered written submissions of
both the parties along with the judgments as referred by learned
Senior Advocate and learned counsel for the petitioners.
19. The writ petitioners in S.B Civil Writ Petition Nos.
13864/2023, 12788/2023, 12980/2023, 13200/2023,
13212/2023, 13213/2023, 13229/2023, 13276/2023,
13325/2023, 13358/2023, 13375/2023, 13445/2023,
13446/2023, 13447/2023, 13448/2023, 13449/2023,
13450/2023, 13452/2023, 13694/2023, 13730/2023,
13751/2023, 13862/2023, 13863/2023, 14425/2023,
15127/2023, 15440/2023 and 17017/2023, belongs to Shri
Krishna University and the admission on record clearly indicate
that the RPCMC has revived the registration after decision of
general body meeting of RPMC under Section 32 of the Act of
2008. After the decision of revival, nothing survives as regard to
these petitions are concerned as the impugned cancellation order
has already been revoked by RPMC. Thus, these writ petitions are
liable to be allowed with consent of the RPMC.
20. Now comes the question about another universities.
Regulation 42 of Regulation 2014 (pre-amended) provides for
prescribed eligibility for registration and same is reproduced as
under:-
“Regulation 42-Eligibility for registration – The
following persons shall be eligible for registration.-
(i) who has obtained certificate of a Para-medical
course from any Government body or private body
permitted by the Government for the purpose who
has run the course and awarded certificate before
the commencement of these regulations.

(ii) who has passed the Para-medical course from
any institution recognized by the Rajasthan Para-
medical Council.
(iii) who has passed the Para-medical course from
any institution Government body, outside the
territories of Rajasthan, recognized for the purpose
by the concerned State Government or Central
Government.
(iv) who has passed the Para-medical course from
any institution, outside the territories of India,
recognized for the purpose by the Government of
the country concerned and verified by Government
of India”
21. Regulation 43 provides for registration whereas Regulation
48 prescribes for removal from register and we are reproducing
both as under:-
“Regulation 43-Registration.- Every person who
is eligible for registration at the time of
commencement of these regulations shall apply for
registration within three months of the
commencement of these regulations and the person
who becomes eligible for registration after
commencement of these regulations shall apply for
registration within thirty days from the date on
which he became eligible for registration.
Regulation 48- Removal from the register- (1)
Subject to the provisions of the Act, where the
Registrar is satisfied after giving a reasonable
opportunity of being heard and after making such
further enquiry, as he may think fit, he may order
that the name of any person shall be removed from
the register if-
(a) The person dies;
(b)His name has been entered in the register by
error, or on account of misrepresentation or
suppression of any material fact; or
(c) He has been convicted of any offence under this
Act or has been guilty of the infamous conduct in
the profession which, in the opinion of the Registrar,
render him unfit to be on the rolls of the register.
(2) The registrar may direct that any person whose
name is ordered to be removed from a register shall
be ineligible for registration under this Act either
permanently or for such period as may be specified.

(3) A person aggrieved by an order may, within
thirty days from the date of order, file an appeal to
the Council and the decision of the Council thereon
shall be final.
(4) A person whose name has been removed from
the register under this regulation shall forthwith
surrender his Certificate of Registration to the
Registrar.”
22. In case of Laxmi Saroj and Ors. vs State of Uttar
Pradesh (Supra), after considering the judgment in case of
Narendra Singh Vs. State of Haryana and Ors. (Supra), Civil
Appeal was allowed by Hon’ble Supreme Court. The issue was
delayed issuance of certificate by State Council, which prevented
petitioner to file registration on time.
23. In case of Narendra Singh Vs. State of Haryana and Ors.
(supra), it was held that once it is found that there is no lapse
and/or delay on the part of the appellant/applicant and/or there
was no fault of the appellant/applicant in not producing the NOC
at the relevant time and when it was produced immediately on
receipt of the same and that to before the appointments were
made and when it is found that the last candidate who is
appointed herein is having less marks than appellant and the
appellant is a more meritorious candidate than the last appointed
candidate, to deny him the appointment is not justifiable at all and
cannot be punished for no fault of him.
24. In case of Sunil Vishnoi and Ors. Vs. State of Rajasthan
and Ors. (supra), the candidates were possessing two Years’
Diploma Course in X-Ray Radiographer Technician from
Mansarovar Global University, Sehore, Madhya Pradesh in the
year, 2022 and they have applied for registration before the
MPPMC, which was issued in their favour and thereafter a NOC

was issued in favour of the petitioners for seeking registration
before the RPMC. A Coordinate Bench observed that despite
completion of all the formalities on part of the petitioners, the
RPMC withheld the applications of the petitioners and caused delay
in issuance of the registration certificate in question, which is not
justified in law.
25. The RPMC was constituted under the Act of 2008 and to
strengthen the regulatory network of RPMC, Regulations of 2014
were promulgated by the State of Rajasthan, which was further
amended on 25.08.2015, and lastly in 2023. The Regulation 41
provides for recognition of certain courses with duration and
eligibility, run by recognized institutions. The syllabus for diploma
courses mentioned therein is also specified in different schedules.
Regulation 52 and 53 of Regulation 2014 (as amended), a
requisite infrastructure and facility is required in the institution.
There is a format under Regulation 52 (2) and (3) to submit
application for recognition, which is followed by an inspection by
RPMC.
26. The Act of 2008 was enacted to provide for constitution of
paramedical council, regulation of paramedical professionals and
recognition of institutions imparting education or training in
paramedical subjects in the State and for matters connected
therewith or incidental thereto. Section 13 provides for powers
and functions of the RPMC.
27. Section 17 of the Act of 2008 provides that a person having
recognized para-medical qualification shall be entitled to register
as a paramedical professional. Section 18 provides for application
and Section 19 empowers Registrar for disposal of application.

28. Chapter-IV of the Act of 2008 provides for recognition of
institution whereas Chapter-V provides for recognition of certain
qualification. Section 32 of the Act of 2008 is a very important
provision, required to be invoked in the cases on hand and the
same is reproduced as under:-
“32. Qualifications granted outside the
territories to which this Act extends.- The
Council, if it is satisfied that any Qualification in
Para-medical subjects granted by an authority
Outside the territories of the State of Rajasthan
affords a sufficient guarantee of the requisite skill
and knowledge, may declare such qualification to
be a recognized qualification for the purpose of this
Act, and may for reasons appearing to it sufficient
at any time declare that such qualification shall be
deemed, subject to such additional conditions, if
any as may be specified by the Council, to be
recognized only when granted before or after a
specified date.
Provided that no person other than a citizen of
Indian, possessing such qualification shall be
deemed to be qualified for registration under this
Act unless by the law and practice of the State or
Country, in which the qualification is granted,
persons of Indian origin holding such qualification
are permitted to enter and practice as Para-medical
profession.”
29. Section 33 prescribes that the declaration under Section 32
shall be made by resolution passed at a meeting of Council and
shall have effect as soon as it is published in the Official Gazette.
Section 42 empowers the State Government to frame rules and
regulations for working of the RPMC and the matters incidental
thereto.
30. Regulation 42 which we have reproduced, was amended by
RPMC (Amendment) Regulation, 2023 indicates that Regulation 42
which we are referred above, has been substituted with a new

Regulation 42. It provides that the person who has domicile of
Rajasthan shall be eligible for registration, if they have obtained
diploma and degree of para-medical courses from any
Government body or private body permitted by the Government
for the purpose who has run the course and awarded diploma and
degree before the commencement of these regulations, who has
passed the paramedical course from any Institution/Government
Body, outside the territories of Rajasthan recognized for the
purpose by the concerned State Government or the Central
Government, Medical Department and if registered with respective
State/U.T. Paramedical Council applied with cancellation of
respective State Council registration and NOC on the Council, shall
be deemed eligible for registration with RPMC. Regulation 51 is
also amended by amendment in 2023. The amended regulation 42
is reproduced as under:-
“42. Eligibility for registration:-
The following persons who has domicile of
Rajasthan shall be eligible for registration:-
(i) who has obtained diploma and degree of a
Para-medical course from any Government body or
private body permitted by the Government for the
purpose who has run the course and awarded
diploma and degree before the commencement of
these regulations;
(ii) who has passed the Para-medical course
from any institution recognized by the Rajasthan
Para-medical Council;
(iii) who has passed the Para-medical course
from any institution/Government body, outside the
territories of Rajasthan, recognized for the purpose
by the concerned State Government or Central
Government Medical Department, and if Registered
with respective State/Union Territories Para-
Medical council applied with Cancellation Certificate
of respective State Council registration and NOC of
the council;

(iv) who has passed the Para-medical course
from any institution, outside the territories of
India, recognized for the purpose by the
Government of the country concerned and verified
by Government of India;
Provided that such person(s), who has/have
acquired Para-Medical Diploma through distance
education mode prior to year 2015 shall be given
an option to appear for an examination to be
conducted by the Council if they so desire. Such
person(s), who, opts/opt to appear for the
examination, which shall be conducted by the
Council, pass the aforesaid examination, they
would be deemed to have qualified as per the
regulations and they shall be deemed eligible for
registration with Rajasthan Para-Medical Council
(RPMC).
Provided further that the aforesaid option shall
only be provided once and it shall not be treated
as a precedent.
Provided also that such person(s), who will/have
acquired Para-Medical Degree and Diploma prior to
June 2023 from such University established by an
Act of the Government of Rajasthan and obtain
recognition from Rajasthan Para-Medical Council
within 6 months from the date of publication of
these Regulations shall be given an option to
appear for an examination to be conducted by the
Council if they so desire. Such person(s), who,
opts/opt to appear for the examination, which shall
be conducted by the Council, pass the aforesaid
examination, they would be deemed to have
qualified as per the regulations and they shall be
deemed eligible for registration with Rajasthan
Para-Medical Council (RPMC):
Provided also that the aforesaid option shall only
be provided once and it shall not be treated as a
precedent.”
31. The case of the petitioner(s) is that after taking admission in
different universities, they have completed the course and got
registered by the MPPMC. The MPPMC has issued NOC to the
petitioners in remaining 12 cases and on the basis of the NOC the
petitioners of these 12 Writ Petition No.13439/2023, 13440/2023,

13442/2023, 13443/2023, 13444/2023, 14355/2023,
15621/2023, 15852/2023, 13596/2023, 13199/2023, 13761/2023
and 15378/2023 applied for registration in the state of Rajasthan.
These petitioners have obtained diploma from PK University,
Sardar Patel University, Satya Sai University and AISECT
University (now known as Rabindranath Tagore University) (all
statutory private Universities in Madhya Pradesh).
32. As per amended regulation 42, any person who has passed
the Paramedical course from any institution/government body
outside the territory of Rajasthan recognised for the purpose of
concerned State Government or Central Government, is eligible for
registration by RPMC.
33. In case of Sharwan Ram Badiyasar Vs. State of
Rajasthan and Ors. : S.B. Civil Writ Petition No.17278/2021
and other connected matters, a Co-ordinate Bench at Principal
Seat, Jodhpur has considered writ petitions of the candidates who
procured diploma from different universities of Madhya Pradesh
and were registered by MPPMC but RPMC in full Council meeting
dated 24.07.2021 has found that diploma certificates obtained
from four private universities namely (i) Dr. Sarvepalli
Radhakrishnan University, Bhopal, (ii) Sri Satya Sai University of
Tehnology & Medical Sciences, (iii) Swami Vivekananda University,
Sagar and (iv) AISECT University Institute of Para Medical
Science, Raisen (MP) are irregular and students of these
Universities are not entitled for registration by RPMC.
34. After considering the material before it, a Co-ordinate Bench
vide order dated 17.11.2022 has observed as under:-
“In view of the fact that this Court has come
to the conclusion that the orders impugned have(Uploaded on 01/03/2026 at 03:11:57 PM)

natural justice, the plea sought to be raised by the
respondents of availability of alternative remedy to
the petitioners against the orders cancelling their
registrations cannot be accepted.
However, despite the fact that the action of
the respondent RPMC has been found in gross
violation of principles of natural justice and there
being no decision by the RPMC for cancellation of
registration of the petitioners, looking to the fact
that the committee has pointed out glaring
discrepancies in the diplomas obtained by several of
the candidates and all the institutions themselves
vide communication sent by M.P.Para Medical
Council dated 13/9/2021 and 21/10/2021
(Annex.18 & Annex.19) have found large number of
students ineligible for grant of diploma and the fact
that ultimately the petitioners would be dealing with
the unsuspecting patients, whose lives would be
dependent on the investigation conducted by the
petitioners, who are seeking recruitment on the
post of Lab Technician and Assistant Radiographer,
the RPMC is required to be afforded an opportunity
to comply with the requirements of principles of
natural justice as well as adopt proper proceedings
i.e. decision by the RPMC in case any action is
required to be taken against the candidates.
As per the reports submitted by the
institutions, several of the petitioners in the present
petitions have been found ineligible by the said
institutions and M.P. Para Medical Council and their
admissions itself have been cancelled by the
institutions, they are not entitled to any relief qua
the cancellation made, however, for lack of specific
information in this regard, though the order was
passed by this Court, no specific order qua such
petitioners is being passed.
So far as CW Nos.7528/2021, 8141/2021 and
9997/2021 are concerned, as the RPMC itself is of
the view that the candidates from the four
institutions were not entitled to participate in the
recruitment and their registration has been
cancelled, no separate order need be passed in the
petitions filed by the petitioners in the said writ
petitions.

found to be unsustainable and the matters are
being remanded back to the RPMC to take
appropriate action in accordance with law, the
petitioners in the above 03 petitions may make
representations to the RPMC pointing out the
material/make submissions with regard to the
candidature of the petitioners in other writ petitions
and it is expected of the RPMC to keep the same in
view while taking decision qua the petitioners in
other writ petitions.
Consequently, except for CW Nos.7528/2021,
8141/2021 and 9997/2021, the writ petitions are
allowed. The order dated 24/7/2021 passed by the
respondent RPMC cancelling the registration of the
petitioners is quashed and set aside. The matters
are remanded back to the RPMC, who is directed to
issue fresh specific notices to the petitioners
pointing out to each individual candidate the
deficiency / ineligibility / disqualification with regard
to their diploma/registration. On notices being
issued, the petitioners shall respond to said notice
within a period of two weeks, which date shall be
fixed by the RPMC in the notice and after affording
opportunity of hearing to the candidates, the RPMC
would pass fresh orders in accordance with law.
It is made clear that till such time the decision
in each individual case is taken by the RPMC, none
of the candidates shall be treated as eligible for the
purpose of recruitment only on account of the fact
that the order dated 24/7/2021 has been quashed
by this Court and only after RPMC record specific
finding about the registration of the petitioners
being valid, they would be treated as eligible by the
respondent Board.
It is further directed that till such time the
inquiry is completed by the RPMC, the respondents
shall keep the posts of selected candidates vacant.
The RPMC is directed to complete the entire
exercise within a period of four months from the
date of this order.
Writ Petition Nos. 7528/2021, 8141/2021 and
9997/2021 are disposed of in terms of the
observations made hereinbefore.”

35. The stand of learned counsel appearing for the RPMC is same
that the course conducted by (i) Satya Sai University and (ii)
AISECT University (now known as Rabindranath Tagore University)
are not recognized. He also submitted that the petitioners, passed
out from PK University and Sardar Patel University may submit
representation along with all documents, which shall be examined
and considered in full house meeting of RPMC.
36. Regulation 42 (amended) as referred hereinabove (Para 27)
clearly provides that the paramedical course from any
institution/Government body, outside the territory of Rajasthan,
recognized for the purpose by concerned State Government or
Central Government then the person shall be eligible for
registration by RPMC.
37. Regulation 43 provides for registration process. Any person
aggrieved from an order or decision of the Registrar under
Sections 19 or 20 or 21 or 22 or 24 may file appeal to the RPMC,
whereas Section 26 further provides appeal from the order of the
Council.
38. In case of Mahendra and Ors. Vs. State of Rajasthan
and Ors. : S.B. Civil Writ Petition No. 4104/2021, decided by
a Co-ordinate bench at Principal seat, Jodhpur, the Court has
directed the RPMC to decide the issue of recognition of the course
run by the university in terms of Section 32 of the Act of 2008 and
Regulation 42 (iii) of the Regulation. It was also directed that for
the purpose of recognition or equivalence, concern university shall
submit details about curriculum and course material or all other
relevant material, as desired. The RPMC was given free hand to

elicit further information in a bit to ensure that course in question
afford sufficient guarantee of requisite skill and knowledge.
39. Having considered the provision and also the ratio as
mentioned in the cases referred hereinabove, it is apparent that
this is not a case of any mistake or a case of negligence. The facts
do not warrant applicability of ratio laid down in case of Narendra
Singh Vs. State of Haryana (supra) followed in case of Laxmi
Saroj and Ors. Vs. State of Uttar Pradesh and Ors. (supra) by
Hon’ble Supreme Court and also by a coordinate bench in case of
Sunil Vishnoi and Ors. Vs. State of Rajasthan and Ors.
(supra).
40. The question pertains to registration of the qualified
individuals as professionals in paramedical field, in the State of
Rajasthan. The qualified paramedicals are not only required for
Government Jobs but also in private sector and private practice. It
ensures safety of patients and compliance with the standards,
prescribed by the Paramedical Council of India.
41. To provide for regulation and maintenance of standard of
education and service by allied and health care professional,
assessment of Institution, maintenance of Central register and
State register and creation of a system to improve access,
research & development and adoption of latest scientific
advancement and for matters connected thereto or incidental
thereto, the Parliament of India has enacted the National
Commission for Allied and Health Care Professionals Act, 2021
which was published in Extraordinary Gazette on dated
25.05.2021 as an appointed date, when the Act came into force.

42. Considering the aforesaid, the case of remaining petitioners
is also a transfer case, as they have earlier registered by MPPMC
but they want registration by RPMC. After growth of private
universities, there are frequent complaints about large scale
admission in courses, without adequate regulatory approvals,
Thus, we are of the view that the matter is required to be
considered by the RPMC (full body) under Section 32 of the Act of
2008. This Court cannot draw a conclusion that the course passed
out from PK University and Sardar Patel University are as per
standard, prescribed by the RPMC. Not a single example is
referred on record to show that identically placed individuals from
PK University and Sardar Patel University are approved for
registration and are continued as such to practice in Rajasthan.
43. The material on record as referred hereinabove clearly
indicated that the RPMC has already considered the case of Sri
Satya Sai University and the AISECT University (now known as
Rabindranath Tagore University) and found that their courses are
irregular as they do not qualify as per regulation in Rajasthan.
Therefore, both the candidates in S.B. Civil Writ Petition
Nos.13761/2023 & 15378/2023 have no ground to pass for
registration, but they have an option to submit a representation in
form of appeal under Section 32 for consideration by the full body
of Paramedical Council (RPMC).
44. Having taken note of the provisions under the Act of 2008
and further regulation of 2014 (as amended from time to time),
we are of the considered view that a professional paramedical
course of other State has to be recognized and must have
equivalence with as that of State of Rajasthan, then only, persons

from out of Rajasthan be considered for registration in State of
Rajasthan. If the course, undertaken by any of the petitioner is
recognized in the State of MP and sufficient to get registration
from MPPMC, then said petitioner is free to practice in State of
Madhya Pradesh after restoring his registration but he cannot
claim registration in State of Rajasthan on basis of a course which
has no equivalence with the course conducted in the State of
Rajasthan. At all cost, we will not permit anyone to play life of the
public as it may jeopardize health and safety of the citizens of
Rajasthan.
45. In view of discussion made herein above, 27 petitions i.e.
S.B. Civil Writ Petition Nos. 13864/2023, 12788/2023,
12980/2023, 13200/2023, 13212/2023, 13213/2023,
13229/2023, 13276/2023, 13325/2023, 13358/2023,
13375/2023, 13445/2023, 13446/2023, 13447/2023,
13448/2023, 13449/2023, 13450/2023, 13452/2023,
13694/2023, 13730/2023, 13751/2023, 13862/2023,
13863/2023, 14425/2023, 15127/2023, 15440/2023 and
17017/2023, wherein the petitioners have passed out diploma
courses from Shri Krishna University are liable to be allowed,
whereas the writ petitions in 10 cases (7 have passed out from PK
University and 3 from Sardar Patel University), a suitable direction
is required to consider of matter by the Paramedical Council
(RPMC) under Section 32 of the Act of 2008. As regard to
remaining writ petitioners, who have obtained diploma courses
from Shri Sat Sai University and AICTE University, are not entitled
for any specific relief, but they are free to submit a representation
to the RPMC for consideration under section 32 of the Act of 2008.

46. In view of discussion made herein above, these writ petitions
are disposed in following manner:-
(i) The writ petitions i.e. S.B. Civil Writ Petition Nos. 13864/2023,
12788/2023, 12980/2023, 13200/2023, 13212/2023,
13213/2023, 13229/2023, 13276/2023, 13325/2023,
13358/2023, 13375/2023, 13445/2023, 13446/2023,
13447/2023, 13448/2023, 13449/2023, 13450/2023,
13452/2023, 13694/2023, 13730/2023, 13751/2023,
13862/2023, 13863/2023, 14425/2023, 15127/2023, 15440/2023
and 17017/2023 (relating to Shri Krishna University) are allowed
as the RPMC has already revoked the cancellation of their
registration certificate issued to them. It is therefore directed that
there will be no effect of cancellation order upon the petitioners.
(ii) The writ petitions i.e. (7+3=10), S.B. Civil Writ Petition
Nos.13439/2023, 13440/2023, 13442/2023, 13443/2023
13444/2023, 14355/2023, 15621/2023, 15852/2023, 13596/2023
and 13199/2023 (petitioners passed from PK University and
Sardar Patel University) are partly allowed and the RPMC is
directed to hold an inquiry under section 32 of the Act of 2008
about recognition and equivalence of the course conducted by the
PK University and the Sardar Patel University. The Registrar of the
PK University and the Sardar Patel University are directed to co-
operate the RPMC in inquiry. The Medical and Health Department
of Madhya Pradesh Government shall also cooperate in providing
all the relevant information, if required by the RPMC. The
petitioners are directed to file all relevant documents within a
period of 45 days from the date of receipt of copy of the order to
the RPMC. The RPMC shall proceed to enquiry and conclude the

same within a period of 90 days from the date of receipt of
documents from the petitioners. The RPMC shall consider the case
of these petitioners in full meeting of RPMC and decide with a
reasoned and speaking order. Needless to say that a copy of the
order be provided to the petitioners who have submitted the
documents along with representation.
(iii) The writ petition Nos.13761/2023 and 15378/2023 are
hereby dismissed but the petitioners are given liberty to submit a
representation within a period of 45 days to RPMC for re-
consideration of their case under Section 32 of the Act of 2008.
47. With the aforesaid, these writ petitions stand disposed with
pending application(s), if any.
