This is a private complaint filed under section 200 of

Cr.P.C., against the accused for the offence punishable

under section 138 of the Negotiable Instruments Act.

02.The brief facts of the complaint is as under:

The complainant and accused are known to each

other and they are working in Raman Research Institute,

C.V.Raman Avenue, Bengaluru as security guard and

driver. The accused also running a travel business in the

name and style of SLN Tours and Travels. In that cordial

acquaintance, accused has availed loan of Rs.3,00,000/- in

the month of April 1st week 2018 by way of cash from the

complainant in order to meet his financial commitments for

developing his business, family necessity and clearing the

debts borrowed from his. The accused has assured to

repay the same within 6 months. But, the accused failed to

repay the same. To discharge said liability, the accused

has issued a cheque bearing No 722982 dated 30-11-2018

for Rs.3,00,000/-, drawn on ICICI Bank Limited, R.T.Nagar

Branch, Bengaluru, in favour of the complainant. The

complainant presented said cheque for encashment

through his banker Canara Bank, RMV Extension Branch,

Bengaluru. But the said cheque is returned unpaid with

bank endorsement dated 13-12-2018 for the reason

“Account Blocked”. Thereafter, the complainant has got

issued legal notice dated 03-01-2019 both addresses of the

accused through registered post and the same were served

on 05-01-2019. Instead of payment, the accused has sent

untenable reply dated 21-01-2019 through his counsel.
