The instant application for bail under Section 483 of BNSS

(439 Cr.P.C.) has been filed by the petitioner who has been

arrested in connection with F.I.R. No.91/2025, registered at Police

Station Ramsinghpur, District – Sriganganagar, for the offences

under Sections 333, 110, 115(2), 117(2), 118(2), 189(2) of the

BNS.

Heard learned counsel for the petitioner and learned Public

Prosecutor. Perused the material available on record.

Learned counsel for the petitioner submits that the petitioner

has been falsely implicated in this case. It is contended by the

learned counsel for the petitioner that the complainant is the wife

of the petitioner. The petitioner was having some objection with

regard to illicit relations of his wife and, therefore, his wife has

lodged a false case against him. It is further contended by learned

counsel for the petitioner that the injury which was alleged to be

attributed to the petitioner is neither on vital part of the body nor

dangerous to life. Learned counsel for the petitioner therefore,

submits that the case does not travel under Section 117(2) of the

BNS (Section 325 IPC).

Learned counsel submits that the petitioner is in judicial

custody since 03.06.2025 and the challan has already been filed

and the trial of the case will take sufficiently long time, therefore,

the benefit of bail may be granted to the accused-petitioner.

Per contra, learned Public Prosecutor vehemently opposes

the bail application and submits that the petitioner along with

other co-accused persons has beaten the complainant and his

cousin Anis Kumar. Learned Public Prosecutor has drawn attention

of this Court towards the injury report of the Birmadevi

(complainant), in which out of four injuries received by the injured

Birmadevi, three injuries are of grievous nature but they are on

hand and leg.

Having considered the rival submissions, facts and

circumstances of the case, considering that out of 4 injuries

received by Birmadevi, 3 injuries are through grievous in nature

but the same are on hand and leg which are not vital parts of the

body; the petitioner is in judicial custody since 03.06.2025; the

charge-sheet has already been filed and the trial will take

significant time, without expressing any opinion on

merits/demerits of the case, this Court is inclined to enlarge the

petitioner on bail.

Consequently, the bail application under Section 483 of BNSS

(439 Cr.P.C.) is allowed. It is ordered that the accused-petitioner

Puranram @ Raju S/o Shri Dungar Ram, arrested in

connection with F.I.R. No.91/2025, registered at Police Station

Ramsinghpur, District – Sriganganagar, shall be released on bail, if

not wanted in any other case, provided he furnishes a personal

bond of Rs.50,000/- and two sureties of Rs.25,000/- each, to the

satisfaction of learned trial court, for his appearance before that

court on each & every date of hearing and whenever called upon

to do so till completion of the trial.
