                                                 O R D E R

1. We are informed by the learned counsel for the parties

that pursuant to the Mediation, parties have amicably resolved

their disputes by agreeing to part ways.

2. Both the parties are present in-person in Court.

3. The Settlement Agreement dated 03.11.2025 annexed to the

IA No.102943/2026 – joint application for direction seeking

dissolution of marriage by mutual consent, has been filed. The

terms of the said settlement reads as follows:-

“Terms of Settlement

1. That both parties have mutually agreed not to
continue with their matrimonial relationship and
have decided to seek dissolution of marriage
solemnized on 9th December 2021 through appropriate
legal proceedings as per law.

Date: 2026.04.27 2. That Mr. Tushar Sudan has agreed to pay a total sum

Reason:
of ₹10,00,000/- (Rupees Ten Lakhs only) to Miss
Pallavi Dwivedi in full and final settlement of all
her claims arising out of the matrimonial
relationship, including maintenance (past, present,

and future), permanent alimony, stridhan, and any
other claim whatsoever.

3. That upon receipt of the aforesaid amount, Miss
Pallavi Dwivedi shall have no further claim of any
kind against Mr. Tushar Sudan or any of his family
members.

4. Both parties have agreed to withdraw all cases,
complaints, and proceedings filed against each other
before any court, forum, or authority within four
weeks from the date of signing this Mediation
Report.

5. Both parties further undertake that hereafter they
shall not indulge in any criticism, complaint, or
defamatory statement against each other or their
respective family members in any form, including
social media or otherwise.

6. Both parties confirm that this settlement has been
reached voluntarily, without any coercion, threat,
or undue influence, and with full understanding of
its implications.

7. The parties agree that this Mediation Report shall
be binding upon them and may be placed before the
Hon’ble Supreme Court of India in Transfer Petition
(Civil) No. 2 of 2025 for appropriate orders.

Conclusion

1. In view of the above, the dispute between Miss
Pallavi Dwivedi and Mr. Tushar Sudan stands amicably
settled. Both parties have signed this report before
the learned Mediator on their own free will and
consent. That by signing this Agreement the parties
hereto solemnly state and affirm that they have no
further claims or demands against each other
including maintenance, or any movable or immovable
property and all the disputes and differences have
been amicably settled by the parties hereto through
the process of mediation.

2. The parties undertake to abide by the terms and
conditions set out in the above mentioned Settlement

Agreement, which have been arrived with free will of
the parties without any coercion, duress or
collusion and parties undertake not to raise any
dispute whatsoever henceforth.

3. The contents of this settlement – agreement have
been explained to all the parties through their
respective counsels and they have understood the
same.”

4. As per the settlement, the respondent-husband has to hand

over a demand draft re-validated on 05.03.2026 drawn on UCO

Bank for a sum of Rs.10,00,000/-(Rupees Ten Lakhs). The

petitioner-wife along with her counsel duly received the said

demand draft towards full and final settlement of all her

claims, in Court today.

5. As per the settlement, parties have decided to put an end

to disputes, hence, the following proceedings set out in

paragraph 4 of the joint application, will stand

quashed/terminated:-

“a. DV Complaint dated 07.10.2024, bearing Case
No.458/2024 under Section 12 R/w Sections 18, 19, 20 and
22 of the Protection of Women from Domestic Violence
Act, 2005 filed by Petitioner herein in the Court of
Hon’ble Judicial Magistrate First Class, Bhopal;

b. FIR bearing No.299 of 2024 dated 25.10.2024 at Mahila
Police Station, Bhopal under Sections 85, 351(2) & 3(5)
of the Bhartiya Nyaya Sanhita, 2023 and Sections 3 & 4
of the Dowry Prohibition Act, 1961; lodged by the
Petitioner herein;

c. FIR bearing No. 282/2022 dated 07.10.2022 lodged by
Petitioner namely Pallavi Dwivedi at Police Station
Mahila Thana, Jahangirabad, Bhopal, Madhya Pradesh;

d. Divorce Petition bearing H.M.A No.2653 of 2024 filed
by the Respondent namely Tushar Sudan under Section
13(1)(ia)
of the Hindu Marriage Act, 1955 before the
Principal Judge, Family Court, Tis Hazari Court. West
District, Delhi;

e. Proceedings in RCT/15209/2024 titled as “State Vs.
Tushar Sudan and others
“, before VI Civil Judge, Sr.
Division, District and Sessions Court, Bhopal, Madhya
Pradesh. “

6. Since the marriage between the parties has irretrievably

broken down, we, accordingly, in exercise of our jurisdiction

under Article 142 of the Constitution of India, allow IA

No.102943/2026 and grant decree of divorce dissolving the

marriage between the parties.

7. The parties are directed to abide by all the terms and

conditions of the Settlement Agreement without fail.

8. The Registry shall draw a decree accordingly in terms of

the settlement.

9. A copy of this order be sent to the Courts concerned for

placing the same on record of the respective cases and consign

the files to the records.

10. We place on record our appreciation for the efforts made

by the learned counsel for the parties and Mr. Pradeep Kumar

Rai, learned Senior Advocate/learned Mediator, for his

endevour in bringing the parties to a settlement.

11. The Transfer Petition shall stand disposed of

accordingly.

12. Pending application(s), if any, shall also stand disposed

of.
