                                                            O R D E R

1. By order dated 22.04.2025, parties were referred to the

Mediation Centre of this Court to explore possibility of a

settlement between them.

2. Pursuant to the above, a memorandum of understanding /

settlement agreement duly signed by the parties has been placed on

record. The relevant portion of the settlement is extracted below:

“5. Ms. K.R. Chitra, Advocate and Ms. Mandakini
Sharma, Advocate were appointed as the Mediator and
Co-Mediator respectively by the Supreme Court
Mediation Centre for the Mediation proceedings.
Comprehensive mediation sessions were held by the
Mediator with the parties and their respective
counsels. With their assistance, the Parties hereto
have voluntarily arrived at an amicable solution
resolving the matrimonial disputes inter se the
parties.

a. As such the parties have decided to
continue their marriage and cohabit as Husband
and Wife with their child in their matrimonial
home in Muzaffarnagar.

b. Both the parties have mutually agreed
and consented to live together happily along
with their child by forgetting all the previous
incidents and allegations in view of their
bright future. The First Party shall discharge
her matrimonial obligation diligently and shall
take care of her child and Second Party. Also,
the Second Party shall perform his all

maintaining them and providing them good life.

Reason: Both the parties shall avoid any further
dispute by keeping in mind the future of their
minor son.

c. The Parties have further decided to
withdraw all the pending civil cases and seek
quashing of the criminal case, the details of
which are mentioned in Para 2 of this
agreement.

d. For the purposes for withdrawing all the
pending civil cases and quashing of the
criminal case, a joint application under
Article 142 of the Constitution of India will
be filed on behalf of both the parties before
the Hon’ble Supreme Court of India for
appropriate orders seperately.

6. The parties undertake that they are bound by this
Settlement Agreement and further undertake to abide
by the terms and conditions set out in the agreement
and not to dispute the same hereinafter.

7. The parties agree that they have arrived at the
present Settlement Agreement with their own free
will and desire and without any pressure, fraud,
force, coercion or undue influence by either of the
parties or any outsider/third party and they
undertake to be bound by the terms thereof.

8. The parties further agree that they shall appear
before the Hon’ble Court to make their statements in
terms of the present settlement agreement.”

3. In paragraph No.5(d) of the settlement, it is prayed that

pending proceedings between the parties, i.e., civil and criminal

in nature, be quashed. Those proceedings are detailed in paragraph

No.2 of the settlement which is extracted below:

“2. As matrimonial differences arose between the
parties, the Parties filed the following cases:

i. Case No. 420 of 2024 filed by the
Petitioner before the Court of Ld. Principal
judge, Family Court, Dehradun for seeking
maintenance under Section 125 Cr.P.C titled
“Smt. Palak Aggarwal & Anr. Vs. Shri Avnesh
Dixit”;

ii. F.I.R. No. 13 of 2025 dated
09.01.2025 lodged by the Petitioner under
Section 323, 498-A, 504 I.P.C. and Section 3
and 4 of the Dowry Prohibition Act, 1961 at

P.S. Kotwali Dehradun against the Respondent,
father in law Ajeet Kumar Dixit and mother in
law Poonam Dixit;

iii. Divorce Petition No. 753 of 2024
filed by the Respondent before the Ld.
Principal family Judge, Family Court,
Muzaffarnagar Uttar Pradesh titled “Shri
Avneesh Dixit Vs. Smt. Palak Aggarwal”.

iv. Case No. 823 of 2023 filed by the
Respondent before the Ld. Principal family
Judge, Family Court, Muzaffarnagar Uttar
Pradesh titled “Shri Avneesh Dixit Vs. Smt.
Palak Aggarwal” under Section 9 of the Hindu
Marriage Act, 1955.”

4. In view of the above settlement, we deem it appropriate to

invoke our jurisdiction under Article 142 of the Constitution of

India and dispose of this petition in terms of the settlement. As a

result, the proceedings as mentioned in paragraph No.2 of the

settlement shall stand quashed / withdrawn. The petition is

disposed of in the aforesaid terms.

5. Pending application(s), if any, shall stand disposed of.
