This case is registered against the accused for the

offence punishable U/s 138 of Negotiable Instruments

Act.

2. Factual matrix of the complainant’s case is as

under:

It is stated that the complainant knows the accused

from several years. The accused is doing business of

leather bag, fabric bag etc in the name and style of

S.Dharmachand and sons. The complainant was working

in Australia in the year 2008 to October 2015. He was

getting sufficient salary. After coming to India he had

plenty of money with him and he approached the accused

with an intention to get some idea from him to invest

amount in any business. Though accused given some

business, the complainant did not agree for it. Thereafter,

the accused informed the complainant to invest money in

his business and he will get sufficient gain from or he was

also asked to give loan to him for interest.
