1. The present criminal misc. petition, preferred under Section
528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been
filed by the petitioner seeking issuance/renewal of passport and
permission to travel abroad.
2. Briefly stating the facts of the case are that an FIR was
registered against the petitioner under Sections 376 and 509 IPC
on the allegation of establishing relations on a false promise of
marriage, pursuant to which a charge-sheet has been filed and
trial is pending. During the pendency of trial, the petitioner sought
permission for issuance of passport and to travel abroad,
whereupon the trial Court permitted issuance of passport but
declined travel permission without assigning cogent reasons. The
petitioner, being employed with Ajanta Pharma Limited, seeks to
travel abroad for official purposes and has thus approached for

appropriate relief including permission to travel and issuance of
passport for a full term.
