1. We have heard the learned counsel appearing for the

parties.

2. This Transfer Petition has been filed by the

petitioner-wife under Section 25 of the Code of Civil

Procedure, 1908 seeking the transfer of divorce petition

bearing HMA No.1768/2024 titled ‘Sahil Aneja v. Neha Khanna’

pending before the Family Court, West District, Tis Hazari

Courts, Delhi to the Family Court, Meerut, Uttar Pradesh.

3. The parties were referred to mediation vide order of

this Court dated 20.08.2025 and the parties have amicably

settled the matter.

4. Both the parties are present in Court.

5. A joint application has been filed by both the learned

counsel appearing for the parties as I.A.No.53697/2026.

bringing to the notice of this Court a Settlement Agreement

dated 20.12.2025, duly signed by both the parties and

attested by the learned counsel for both the sides, and the

resolved between the parties.

6. In tune with the said Settlement Agreement, the

monetary consideration i.e. a sum of Rupees five lakhs, as

full and final settlement amount, has been handed over by

the respondent-husband to the petitioner-wife in the

presence of the learned Mediator by way of a demand draft in

favour of the petitioner-wife. What survives is the closure

of the following pending proceedings as mentioned in

paragraph 5 of the Settlement:-

“(i) Case No. 923 of 2020 titled as Smt. Neha Vs.
Sahil Aneja under Section 125 Cr.P.C. pending In the
Court of Ms. Mita Singh, Additional Principal Judge,
Court No. 1.

(ii) Complaint Case No. 4747 of 2019 titled Neha
Khanna Vs. Sahil Aneja & Anr. under Section 498A, 323,
504, 506 IPC and 3/4 Dowry Provision Act pending in
the Court of First Civil Judge, Junior Division, Court
No. 1; Meerut.

(iii) H.M.A. No. 1768 of 2024 titled Sahil Aneja Vs.
Neha Khanna, pending before Ld. Judge Family Court 02,
West District, Tis Hazari Court, Delhi.

(iv) Complaint Case No. 20908 of 2023 titled Veena
Aneja Vs. State of U.P. & Ors.
under Section 323, 504,
506 pending in the Court of ACJM, Court No. 5,
Meerut.”

7. We are of the view that we can invoke our power under

Article 142 of the Constitution of India, 1950 and grant

decree of divorce by mutual consent between the parties by

closing the aforesaid pending cases between the parties.

8. Accordingly, by invoking our power under Article 142

of the Constitution of India, 1950 there shall be a mutual

divorce between the parties, as agreed upon and the pending

proceedings in paragraph 6 of this order, are hereby closed.

9. Copy of the order be sent to the respective Courts for

placing the same on files of the respective cases and

consign these to record.

10. We make it clear that henceforth, the parties shall

not make any claim as against each other. The settlement

that has been duly arrived at between the parties shall form

a part of this order. Needless to state that the parties

are bound by the terms of settlement which have been arrived

at between them. A decree of divorce be drawn up

accordingly.

11. I.A. No.53697/2026 is allowed and the Transfer

Petition stands disposed of on the aforesaid terms.

12. Pending application(s), if any, shall also stand

disposed of.
