The complainant has filed the present complaint
U/Sec.200 of Cr.P.C., alleging that the accused has
committed the offence punishable U/Sec.138 of Negotiable
Instruments Act (herein after referred as N.I.Act).
2. The case of the complainant in brief is as follows:-
The complainant and accused were friends as well as class
mates. As such, on 15-09-2020 the accused approached the
complainant for a hand loan of Rs.30,00,000/- which is
required to clear other hand loans and family necessities. As
per the request of the accused, the complainant has lent a
sum of Rs.30,00,000/- on 16-09-2020 to the accused by
mortgaging the property and from other sources. At which
point of time, the accused has assured and promised to
return the above said amount within one year from the date
of receiving the said amount. After the lapse of one year,
complainant has demanded the accused to return the
amount, but the accused keep postponing the dates for one
or the other reasons. Finally on 16-11-2021 the
complainant has demanded the accused to repay the hand
loan amount and towards the discharge of the liability the
accused has issued cheque bearing No.676566 dated 17-11-
2021 for Rs.30,00,000/- drawn on Canara bank,
Kammasandra branch, Bangalore.
