Nandyala Raviteja vs The State Of Andhra Pradesh on 1 August, 2025

The instant petition under Section 482 of Code of Criminal Procedure,

19731 has been filed by the Petitioners / Accused Nos.3 to 6, seeking

quashment of proceedings against them in C.C.No.1203 of 2020 on the file of

the Court of II Additional Judicial Magistrate of First Class, Bhimavaram for the

offence punishable under Section 498-A of the Indian Penal Code, 18602 and

Sections 3 and 4 of the Dowry Prohibition Act, 19613.

2. Sri K.V.L.Narasimha Rao, learned counsel for the Petitioners would

submit that Respondent No.2 / De facto Complainant and Accused appeared

the trial Court and the matter was settled before Lok Adalat and the Accused

were acquitted under Section 320 (8) Cr.P.C. However, it was observed that

the Award would come into force after expiry of 90 days mandatory period of

observation and both parties were directed to appear before the Court on

18.02.2021. Learned counsel would further submit that, thereafter, Accused

No.1, who is the husband and Accused No.2, who is the mother-in-law of the

De facto Complainant, died. Since the Accused and the De facto Complainant

could not appear before the Court, the case is still pending. It is further

submitted that, the Petitioners / Accused Nos.3 to 6 are suffering because of

the pendency of the case, though the matter was settled and an Award was

also passed.
