These judgments arises out of claim petitions
filed by the claimants against respondents under
Section 166 of Motor Vehicles Act, 1988
(hereinafter referred as “Act”) praying to award
compensation in respect of the injuries sustained
by them in the road traffic accident occurred on
09.08.2023.
2. The case of the claimants in nutshell is
that:
On 09.08.2023 at about 4.30pm, the petitioner
in MVC 6273/2023 was riding Two wheeler Royal
Enfield bearing No.KA-03-KK-9996 and the petitioner
in MVC 6274/2023 was a pillion rider in the said Two
wheeler were proceeding towards Gudivanka Sri.
Subramanya Swamy Temple from their village, while

they reached near at Gesikapalli Cross, near
Gesikapalli Village, Shanthipuram Mandalam,
Kuppam Taluk, Chittoor District, Andhra Pradesh on
Kuppam-KGF Road a Mahindra Bolero Pickup Goods
vehicle bearing Reg.No.KA-08-A-1128 came from
opposite direction i.e., from KGF side in a rash and
negligent manner, endangering human life and
violently dashed against the petitioners two wheeler.
As a result of which, both petitioners fell down and
sustained grievous injuries.
