The complainant has filed the present complaint under
Section 200 of Cr.P.C. against the accused for the
commission of an offense punishable under section 138 of
Negotiable Instruments Act.

2. The case of the complainant in brief is as under:-

“The accused is known to the complainant from several
years. In the month of August 2023, the accused had
approached the complainant and borrowed hand loan of
Rs.3,00,000/- by way of cash on 15.08.2023. The accused
has agreed to repay the said amount within four months.
Thereafter when the complainant has demanded for
repayment of said amount, the accused had issued cheque
bearing No.000044, dated 11.12.2023 for a sum of
Rs.1,50,000/- drawn on Kotak Mahindra Bank, Modi
Hospital branch, Bengaluru. Another cheque bearing

C.C.No.8904/2024

No.000043, dated 18.12.2023 for a sum of Rs.1,50,000/-
drawn on Kotak Mahindra Bank, Modi Hospital branch,
Bengaluru in favour of complainant. On presentation of said
cheques by the complainant through his banker HDFC
Bank, Vijayanagar Branch. The said cheques have been
returned for the reason “Funds Insufficient” on 19.12.2023.
