1. Heard Shri Arvind Kumar, the learned counsel for the petitioners.

By means of the instant petition filed under Article 227 of the Constitution of India, the petitioners have challenged the validity of an order dated 08.09.2025 passed by the learned Additional District Judge, FTC New, Sitapur in Civil Misc. Case No.28 of 2024 rejecting an application under Section 5 of the Limitation Act.
3. It was stated in the application that pairvi of Regular Suit No.36 of 2004 was done on behalf of all the plaintiffs by defendant No.5- Mohd. Wasim, who died on 15.02.2017. Rest of applicants had no knowledge about the proceedings. They got knowledge of the proceedings only when the defendants came to the land in dispute on 22.02.2024 and tried to remove the chaos put by the applicant No.1. Thereupon the applicants contacted their counsel on 23.02.2024, who told that the case has been dismissed and the file had been sent to Sitapur. After obtaining the judgment dated 25.07.2007, they have filed an appeal against the said order.
