1. The instant bail application has been filed under Section 483
BNSS on behalf of accused-petitioners. The accused-petitioners
have been arrested in connection with FIR No. 154/2024
registered at Police Station Parsoli, District Chittorgarh for the
offences under Sections 8/15, 29 of NDPS Act and Section 134
and 187 of Motor Vehicles Act.
2. Learned counsel for the accused-petitioners submits that the
accused-petitioners have falsely been implicated in this case for
the offences under Section 8/29 of NDPS Act. He further
contended that the recovery of contraband article was effected
from an abandoned vehicle and there is no involvement of the

petitioners with the transportation of alleged quantity recovered
from abandoned vehicle. He further argued that similarly placed
co-accused Kalulal has been granted bail by a Coordinate Bench of
this Court vide order dated 13.03.2026. The charge-sheet has
already been filed and the accused-petitioners are in custody since
long and the trial of the case may take considerable time,
therefore, the bail application of the accused-petitioners may be
allowed.
3. Learned Public Prosecutor has vehemently opposed the bail
application.
4. Heard and perused the material available on record.
5. Considering the arguments advanced by learned counsel for
the petitioners and the fact that similarly placed co-accused has
been granted bail and admittedly the recovery of contraband
article was effected from an abandoned vehicle, therefore,
considering the aforesaid fact and the fact that the accused-
petitioners are in custody since long and the trial of the case may
take considerable time, without commenting anything on the
merits of the case, I deem it just and proper to enlarge the
accused-petitioners on bail.
6. Accordingly, the bail application under Section 483 BNSS is
allowed and it is ordered that the accused-petitioners Mukesh
Kumar S/o Lakhama and Omprakash S/o Hazari Lal, in
connection with FIR No. 154/2024 registered at Police Station
Parsoli, District Chittorgarh shall be enlarged on bail provided each
of them furnishes a personal bond in the sum of Rs.50,000/- with
two sureties of Rs.25,000/- each to the satisfaction of the learned

trial Judge for their appearance before the court concerned on all
