01. By this petition, petitioner has challenged the Superadnama dated
02.12.2025, and the order dated 28.11.2025, regarding land
measuring 04 Kanals and 01 Marla falling under Survey No. 569
situated in Estate Gusoo Tehsil Rajpora, District Pulwama, passed by
the Naib Tehsildar, Rohama. He has also challenged the order
09.09.2017, passed by the Additional Deputy Commissioner,
Pulwama, by virtue of which mutation No. 995 attested under Section
4 and mutation No. 10160 attested under Section 8 with respect to
land measuring 04 Kanals and 01 Marlas has been set aside with a
direction to conduct enquiry with regard to the land in question for
conferment of proprietary rights.
02. It is stated by learned counsel for the petitioners’ that without
conducting any enquiry, the order impugned has been passed against
the petitioners. He has further stated that only property rights have

been taken away from the petitioners in terms of order dated
09.09.2017, however, they continue to be the tenants of the said
property for the last more than eight decades for which they have also
deposited the requisite rent.
03. Learned senior counsel has relied upon the Judgment passed by this
Court in WP(C) No. 65/2026 titled Mohammad Maqbool Magray Vs.
UT of J&K and Ors., and states that the instant case is similar to the
said case.
04. Notice in main case as well as in CM returnable within the same
period. Requisites within one week.
05. List along with WP(C) No. 65/2026 on 04.05.2026.
06. In the meantime, subject to objections of other side and till next date
of hearing before the Bench, Superadnama dated 02.12.2025, and the
order dated 28.11.2025, shall remain stayed.
07. Alteration, modification, or vacation on motion.
