05. 1. The petitioner is an accused in connection with G.R. Case

No.1823 of 2023 corresponding to S.T. Case No.19 of 2024 arising

out of Beguniapada P.S. Case No.394 of 2023 registered for the

alleged commission of the offence under Section 302 of I.P.C.

pending in the Court of the learned Additional Sessions Judge,

Khallikote.

2. The allegation against the petitioner in the F.I.R. is that on

04.10.2023, the informant lodged a written report alleging therein

that his son was working as GRS at Sana Ustapada Gram Panchayat

under Beguniapada Block and he used to visit his work place at

10.00 A.M. and returned back at evening hour. On 03.10.2023, he

had been to his office but did not return. It is alleged that on the

next date i.e. 04.10.2023 at about 7.00 A.M., the informant found

his son dead due to excess bleeding. Hence, the F.I.R.

3. The statement of one Geeta Mohanty has been recorded

under Section 164 Cr.P.C during investigation. At the instance of

the present petitioner, the recovery of weapon of offence has been

affected in presence of one Judhistira Padhiali and Bulu Dalai.

4. Since the afore-named three vital witnesses are yet to be

examined by the prosecution, I am not inclined to entertain the bail

plea of the petitioner at this stage owing to the nature of allegation

against the petitioner. However, liberty is granted to the petitioner

to renew his bail plea after the examination of Geeta Mohanty,

Judhistira Padhiali and Bulu Dalai. Learned trial Court is directed to

examine these three witnesses preferentially over all other witnesses

within a period of three months hence. The petitioner is also granted

liberty to renew his bail plea after the examination of

aforementioned three witnesses or after expiry of three months,

whichever is earlier.

5. With this observation, the BLAPL is disposed of.
