Leave granted.
The appellant, Manohar Singh, is
aggrieved by the denial of anticipatory bail
by the High Court of Punjab and Haryana at
Chandigarh, vide order dated 16.10.2025
passed in CRM-M No. 58583/2025 (O&M), in
connection with First Information Report
(FIR) No. 148/2024 dated 30.05.2024
registered with Police Station – Julana,
District – Jind, Haryana, for the offences
punishable under Sections 15(c), 27A and 29
of the Narcotic Drugs and Psychotropic

granted protection from arrest to the
appellant, Manohar Singh, subject to the
condition that he joins and cooperates with
the investigation in relation to the
aforestated FIR.
The State of Haryana filed a counter
affidavit, wherein it is stated that,
pursuant to the order passed by this Court,
the appellant joined the investigation on
09.01.2026 and made his disclosure
statement.
Though it is contended before us that
the appellant, Manohar Singh, is the kingpin
and he is the one responsible for the
commission of the offence, it is an admitted
position that no recoveries have been made
pursuant to the so-called disclosure
statement of the appellant. The name of the
appellant was not even mentioned in the FIR.
It is also admitted that the appellant has
no past criminal antecedents and he is not a
proclaimed offender. Except for the
statement made by the co-accused implicating
Crl.A. @ SLP (Crl) No. 17915/2025 2
the appellant and his own disclosure
statement, the State has no other
independent evidence as on date to clearly
link the appellant with the offences alleged
under the subject FIR.
In such circumstances, we find no
grounds made out to deny relief to the
appellant, Manohar Singh.
The appeal is, accordingly, allowed,
setting aside the impugned order dated
16.10.2025.
In the event of the arrest of the
appellant, Manohar Singh, in connection with
aforestated FIR, he shall be released on
bail forthwith on such appropriate terms and
conditions as may be fixed by the Special
Court.
The appellant shall also abide by the
conditions stipulated in Section 482(2) of
the Bharatiya Nagarik Suraksha Sanhita,
2023.
We clarify that we have not made any
observations/comments on the merits of the
Crl.A. @ SLP (Crl) No. 17915/2025 3
case and any observation made in this order
is meant only for the limited purpose of
grant of anticipatory bail.
Pending application(s), if any, shall
also stand disposed of.

The appeal is allowed, setting aside the impugned order dated
16.10.2025, in terms of the signed order.
In the event of the arrest of the appellant, Manohar Singh, in
connection with First Information Report (FIR) No. 148/2024 dated
30.05.2024 registered with Police Station – Julana, District –
Jind, Haryana, for the offences punishable under Sections 15(c),
27A and 29 of the Narcotic Drugs and Psychotropic Substances Act,
1985, he shall be released on bail forthwith on such appropriate

terms and conditions as may be fixed by the Special Court.
The appellant shall also abide by the conditions stipulated in
Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
