3. Appellant, who has been arraigned as an accused in FIR

No. 93/2024 for the offences punishable under Sections 8, 15

and 29 of Narcotic Drugs and Psychotropic Substances Act

(NDPS Act) is seeking for grant of regular bail as his

prayer came to be rejected by the Courts below.

4. The case of the prosecution is that on 23.02.2024

Reason:
reliable information that a vehicle would be carrying poppy-

straw (Dodachura) and on intercepting the suspected vehicle,

they found two persons sitting, namely, appellant herein

(A2) and one Narpat Singh (A1) and said car was piloted by

another car which was driven by Bhawani Singh (A3) and the

vehicles were heading towards Gujarat. On their

interception, they found that vehicle driven by appellant

contained nine plastic sacks of poppy-straws weighing about

175 kgs from the second vehicle, namely, vehicle in which

appellant herein and A1 were traveling. Hence, the FIR came

to be filed.

5. After investigation, chargesheet came to be filed and the

prosecution has cited 24 witnesses. Till date none of the

witnesses have been examined, though charges have been

framed.

6. Having regard to the fact that car driven by the Bhawani

Singh, which was said to be piloting the car driven by the

appellant, has been released on bail and even though charges

have been framed and 24 witnesses have been cited, till date

none of the witnesses have been examined, as such the trial

would take its own time and there being no criminal

antecedents attributable to the appellant, his continued

incarceration is not warranted. Hence, he is ordered to be

released on bail.

7. Accordingly, appeal is allowed. Impugned order is set

aside. Appellant is ordered to be released on bail on such

terms and conditions as the jurisdictional court may deem

fit to impose and also on the condition that appellant would

appear before the jurisdictional court on all dates of

hearing except when exempted for any specific reason.

8. It is also made clear that in the event of any other case

being registered against the appellant for similar offence,

the prosecution would be at liberty to seek for cancellation

of bail granted by this Court by filing an appropriate

application before the jurisdictional trial court.
