Mr. N.D. Chullai, learned AAG assisted by Ms. K.C.H. Nongrum,
learned GA is present on behalf of the respondents Nos. 1, 2 & 3. Mr. J.N.
Rynjah, learned counsel is present on behalf of the respondent No. 4, and
Mr. T.T. Diengdoh, learned Senior counsel assisted by Mr. J.K. Pariat,
learned counsel is present on behalf of the respondents Nos. 5 & 6, so no
further notice is called for in respect of these respondents.

Issue notice to the respondent No. 7, by registered AD post, within
3(three) days.

The petitioner which is a company engaged in providing
consultancy technological services under the Power sector and has
obtained the distribution franchise from the respondent No. 4 (MePDCL),
is aggrieved with the respondent No. 7 (Headman of Mawsynram), who
in a matter that concerns distribution of electricity for public good, has not
issued an NOC to allow the company to obtain a Trading license, from the
KHADC.

It is submitted by Dr. N. Mozika, learned Senior counsel that when
the company had set up an office to start the operations, the Headman with
some local NGOs have shut down the office, and this has affected not only
the functioning of the petitioner but also the schedule for putting in place
the distribution system. He further submits that though the company is
applying for a Trading license under “The United Khasi-Jaintia Hills
District (Trading by Non-Tribals) Regulation, 1954”, this has been by
abundant caution as the same would actually not apply, as the company is
not engaged in any wholesale or retail trade, but only providing services
to supply electricity to the concerned area.

Mr. N.D. Chullai, learned AAG for the respondents Nos. 1, 2 & 3,
submits that the State respondents will initiate immediate inquiry into the
allegations made by the petitioner company, as the action of the
respondent No. 7, is totally against public interest.

Mr. T.T. Diengdoh, learned Senior counsel for the District Council
respondent prays that he be allowed to obtain instructions, as to whether
in such contracts, a Trading license will be required at all, under the
provisions of the Regulation.

In this view of the matter, list this matter on 03.03.2026.
Registry to direct for service of notice on the respondent No. 7
(Headman of Mawsynram), through the Officer-in-Charge, Mawsynram
Police Out Post, for appearance on the next date.
