02. IA No. 2748 of 2025 (Arising out of MACA No. 1284 of
2025)

1. This matter is taken up through Hybrid
Arrangement (Virtual/Physical Mode).

2. In the appeal in MACA No. 1284 of 2025, there
is a delay of 7 days, but the appellant has preferred an
application U/S. 5 of the Limitation Act in IA No.2748 of
2025 for condonation of delay in preferring such appeal.

3. Heard. Mr. Anupam Dash, learned counsel for the
appellant in MACA No. 1284 of 2025; Mr. Biranchi
Narayan Rath, learned counsel for R-1 to R-4 in the
matter for condonation of delay, but none appears for R-5
despite valid service of notice.

4. After having considered the rival submissions
and on going through the averments taken in the IA,
since the delay appears to be neither intentional nor
deliberate, rather being for a sufficient cause, the delay is
hereby condoned. Accordingly, IA No. 2748 of 2025
stands disposed of.

IA No. 2688 of 2025 (Arising out of 1248 of 2025)

5. The appellants in 1248 of 2025 has filed IA No.
2688 of 2025 under Rule-22(2) of the Orissa Motor
Vehicles (Accident Claims Tribunal) Rules, 1960 (in
short, “the Rules”) for exemption from paying of Court
fees for time being.

6. Heard, Mr. Biranchi Narayan Rath, learned
counsel for the appellants and perused the record.

7. After hearing learned counsel for the appellants
and on going through the averments of the IA, the
prayer of the appellants for exemption of payment of
Court fees for the time being stands allowed till disposal
of this appeal. It is, however, made clear that the
appellants shall be liable to pay the Court fees as
exempted by this order after disposal of the appeal.
Accordingly, the IA No.2688 of 2025 stands disposed
of.

8. Accordingly, on being agreed by the learned
Signature Not Verified counsel for the parties, list both these appeals on
