This is a suit filed by the plaintiff against the
defendant for recovery of a sum of Rs.9,43,651/- along
with interest @ 18% per annum from the date of the suit
till its realization with costs.
2. The brief facts are as under:-
The plaintiff is a Private Limited Company registered
under the Companies Act, 1956/2013, having its
registered office at No. 112 A, Adarsh industrial Estate,
Chakala, Sahar Road, Andheri (E), Mumbai-400099 and
a branch office Bengaluru engaged in the business of

Solutions and Customs Brokering. The Defendant is
Private Limited Company, registered under the
Companies Act and is engaged in the business of
manufacturing plant extracts and natural ingredients for
developing specific solutions in food, health and beauty
sector in the local market as well as out of India. That
considering the nature of Defendant’s business, the
Plaintiff approached the Defendant to provide the
services for the shipping and custom clearing the cargo
into India as well as out of India via Air mode as well as
via Sea mode. Considering the services offered by the
Plaintiff, the Defendant have engaged the Plaintiff for
transportation of their cargo on 5.11.2022 from
Bangalore CENTRAL WAREHOUSING CORPORATION
(CWC) to CIF Le Havre Port, France. Accordingly, the
cargo was shipped to Le Havre Port on CIF terms and 3
invoices bearing Nos. KA/7329/22-23, KA/56460/22-23
and KA/56461/22-23 were raised by the Plaintiff. The
Defendant has cleared the said Invoices of Rs.22,199/-
