1. The matter comes upon an application for vacating ad
interim stay order passed by this Court dated 22.01.2026.
2. Learned counsel appearing on behalf of the respondent-writ
petitioners submits that an interim order was passed in their
favour by the learned Single Judge on 21.11.2025 and the writ
petitioners-applicants were allowed to continue as contractual
employees as they were working prior to the appointment of the
new placement agency. Learned counsel further points out that an
application was moved by the appellant to vacate the interim
order before the learned Single Judge by moving an application
under Article 226(3) of the Constitution of India. However, without
awaiting the result of the said application, the present appeal has
been filed before this Court and an interim order has been passed
on 22.01.2026 by the Division Bench without noticing the
aforesaid fact and pendency of the application under Article
226(3) of the Constitution.
3. Learned counsel further submits that it is a well settled law
that contractual employees cannot be replaced by another set of
contractual employees. He submits that the State has also framed
Rajasthan Contractual Hiring to Civil Posts Rules, 2022 under

Article 309 of the Constitution of India, which would govern the
field. However, the learned Division Bench while passing the order
of stay has not considered these aspects. Learned counsel submits
that the order passed by this Court dated 22.01.2026 deserves to
be set aside and the appeal also deserves to be dismissed as it
has been filed against an ad interim stay order while the
application for vacation was pending before it.
4. Per contra learned counsel appearing on behalf of the
appellant submits that since the interim order was passed without
giving an opportunity of hearing and the stay vacation application
was not being heard, the present appeal has been filed. Learned
counsel further submits that the placement agency has been
chosen by the Government to provide the contractual employees
and a placement agency cannot be forced to engage the same
contractual employees, who were working in another placement
agency. Learned counsel submits that the judgments were cited
before the Division Bench, which would be applicable to the case
and the stay order passed by the Division Bench, therefore, does
not warrant any interference.
5. We have considered the submissions.
6. It is a case where a writ petition has been pending and
ex-parte interim order was passed and an application was moved
by the respondents for vacating the ex-parte interim order in
terms of provisions contained under Article 226(3) of the
Constitution. However, without waiting for the decision of the said
application, appeal has been filed before this Court challenging the
original ex-parte order. In the opinion of this Court, such approach

deserves to be deprecated. One cannot choose two forums at one
point of time, if an application was already pending. It was
required for the appellant to first pursue the same and get a
decision from the learned Single Judge. Thereafter, of-course, if so
advised, this appeal could have been filed and the Court would
have examined the case again on merits, but jumping a queue
and choosing both the forums at the same time is found to be
unjustified.
7. We, therefore, hold the present appeal not to be
maintainable while application for vacation under Article 226(3) of
the Constitution is pending before the learned Single Judge.
8. The appeal is accordingly dismissed. The interim order
passed by this Court also stands vacated. However, our order
passed would not, in any manner, deprive the appellant from
pursuing the application already moved before the learned Single
Judge under Article 226(3) of the Constitution. It would be
decided independently and would not be influenced by the
decision made by in this appeal.
9. All the pending applications stand disposed of accordingly.
