01. This case is registered U/sec.200 of

Cr.P.C based on the written complaint given by the

complainant against the accused for the offence

punishable under Section 138 of Negotiable

CC.No.25977/2015
KABC030727042015

Instrument Act, 1881 (hereinafter called as NI Act

for the purpose of brevity).

02. The case of the complainant in brief is as

under : –

The complainant and accused are known to

each other. The accused has approached the

complainant for hand loan of Rs.6,00,000/- for his

business and domestic purpose. Accordingly, the

complainant has lent the said amount on

12.08.2014 to the accused. Though the accused

has agreed to repay the same within a short span

but he failed to do so. Upon insistence, the

accused has issued a cheque bearing No.023317

dated 09.09.2015 for sum of Rs.6,00,000/- drawn

on State Bank of Mysore, Yelahanka Branch,

Bengaluru. As per the instruction of the accused,

when the complainant has presented the said

cheque for encashment through his Banker, the

same came to be dishonored with an endorsement

as a “funds insufficient” on 15.09.2015. As such

the complainant has issued demand notice dt:
