02. 1. Heard learned counsel for the Petitioner and
learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in
connection with C.T. Case No.1236 of 2024 pending in
the Court of learned JMFC-II, Bhubaneswar, Khurda
arising out Chandrasekharpur P.S. Case No.565 of
2024 for commission of offence punishable under
Sections 341, 294, 323, 325, 307, 354, 506, 509 & 34
IPC.
3. Learned counsel for the Petitioner submits that
he had taken notice at the address as given in the
complaint case instituted at the behest of the Opposite
Party No.2.
4. Perused the note of the Registry that notice
could not be served because of incomplete address.

5. Learned counsel for the Petitioner, on
instruction, submits that since exaggerated allegations
have been made, he may be protected by pre-arrest
bail.
6. Learned counsel for the State opposes such
prayer.
7. This Court perused the statement of the
complainant as well as the injury report.
8. Taking note of the same, it is directed that on
surrendering within three weeks hence and moving for
bail, the Petitioner shall be released on bail by the
learned Court in seisin on such terms as deemed just
and proper subject to verification of criminal
antecedent of similar nature.
9. If it comes to fore that the Petitioner has any
such criminal antecedent, this order shall not be given
effect to.
10. Before releasing the learned Court shall verify
as to whether this order has been assailed before the
Apex Court and if so, the result thereof.
11. It is needless to state that the Petitioner shall
cooperate with the ongoing investigation.
12. Accordingly, the ABLAPL stands disposed of.
