The complainant has filed the present complaint
U/Sec.200 of Cr.P.C., alleging that the accused has
committed the offence punishable U/Sec.138 of Negotiable
Instruments Act (herein after referred as N.I.Act).
2. The case of the complainant in brief is as follows:-
The complainant and accused are known to each other. As
such during the 1st week of November 2020 the accused had
approached the complainant for hand loan of Rs.4,70,000/-
which is required for his daughter’s marriage expenses. As
per the request of the accused, the complainant has paid
Rs.2,00,000/- to the accused on 23.11.2020 and also paid
sum of Rs.2,00,000/- on 25.11.2020 and Rs.70,000/- by
way of cash. In total accused borrowed Rs.4,70,000/- from
the complainant. After repeated requests and demands
made by the complainant, the accused has issued duly
singed cheque bearing No. 322511 dated 01.07.2021 for
Rs.4,70,000/- which is drawn on Corporation Bank, N R
Colony branch, Bangalore towards the discharge of his
liability and requested to present the cheque for encashment
on 17.08.2021.
