The Court :- 1. Though the learned Advocate appearing for the municipality
has filed a report and would submit that the six storied structure at premises no. 8.
Gobindo Banerjee Lane, P.S. – Charu Market, Kolkata-700033, Ward No. 89, Borough-X
is without the sanction building plan and a notice under Section 401 (A) of the Kolkata
Municipal Corporation Act, 1980 (hereinafter referred to as the said “Act”) has been
issued and filed with the Charu Market Police Station on 22 nd November, 2024, the
learned Advocate for the municipality is however, unable to enlighten this Court as
regards the outcome of this proceeding already initiated under the said Act.

2. Accordingly, I direct the respondent no. 6 to file a report before this Court
and indicate the updated status as regards the investigation, if any, carried out by the
police authority pursuant to the notice issued under Section 401 (A) of the said Act by
the municipality on 22nd November, 2024.
3. The above direction has been issued notwithstanding a report having been
filed by the respondent no. 6 since the same is bereft of any update as regards the
present status of the aforesaid proceedings. Accordingly, updated status of the aforesaid
proceedings must be brought to the notice of this Court by the respondent no. 6, when
the matter is taken up next.
4. List the matter under the same heading on 19 th March, 2026.
