Mr. Jayanta Kr. Mitra, learned Senior Advocate being ably
assisted by Mr. Sarbajit Mukherjee, learned Advocate appearing for the
defendant has moved this application.
This is an application praying for removal of the plaint from the
board on the following grounds :

a) Revocation of leave granted by the Court under Section
12A of the Commercial Courts Act, 2015 (for short "CC
Act"), as the plaint does not contemplate any urgent
interim relief;
b) Revocation of leave granted under Clause 12 of the
Letters Patent, 1865 and
c) The suit is barred by law of limitation.
Mr. Jayanta Kr. Mitra, learned Senior Advocate, on instruction,
submits that the third point on the ground of law of limitation shall not be
pressed at this stage.
Mr. Mitra, learned Senior Advocate has commenced his
submissions and he shall continue tomorrow.
Accordingly, the matter shall appear under the heading
"Adjourned Motion" on February 17, 2026.
