About the Conference
The adoption of the Constitution of India on 26 January 1950 marked a historic moment in the life of the nation. Emerging from the struggles of colonial rule and deep social inequalities, the Constitution represented not merely a legal framework but a collective aspiration to build a just and democratic society.
Over the decades, it has shaped India’s political institutions, protected individual freedoms, and guided the country’s ongoing search for social justice. Traditionally, the idea of constitutionalism has focused on limiting state power, upholding the rule of law, protecting fundamental rights, and maintaining institutional checks and balances. In many countries, however, constitutionalism has gradually taken on a more ambitious role.
Constitutions are no longer viewed only as instruments of restraint; they are increasingly seen as tools capable of guiding social transformation. This evolving understanding is often described as transformative constitutionalism, a vision of constitutional governance that seeks to dismantle historical inequalities and promote dignity, equality, and inclusion in society. Across the world, constitutional democracies are rethinking how their constitutions should respond to persistent inequalities, democratic pressures, and emerging global challenges.
The constitutional experience of South Africa, along with developments in several countries in Latin America and Europe, demonstrates how constitutional frameworks can play an active role in addressing questions of social justice, dignity, and human rights.
This International Conference seeks to bring together scholars, jurists, researchers, and practitioners from across jurisdictions to reflect on these evolving constitutional experiences. By hosting this conference in India, the organisers hope to situate these global conversations within the context of one of the world’s most vibrant constitutional democracies.
