01. Learned senior counsel appearing for the petitioner
after arguing for a while and in view of subsequent
developments, states at bar that the respondents have
initiated the auction process in respect of the land in
question and, therefore, he be permitted to withdraw this
writ petition, with liberty to participate in the said auction
process.
02. The statement of learned senior counsel appearing
for the petitioner is taken on record. The writ petition is
dismissed as withdrawn with liberty as prayed for. Since
the petitioner has chosen not to contest the impugned
notice issued under the SARFAESI Act, the amount of Rs.

45.00 lacs claimably deposited by the petitioner with the
Bank, is directed to be released in his favour.
03. The petitioner shall approach the Bank by tomorrow
to withdraw the said amount of Rs. 45.00 lacs, which is
reportedly kept in a Fixed Deposit Receipt (FDR). Needless
to say, the Bank shall be free to proceed against the
secured asset in accordance with law, including taking
steps for eviction of the tenants, if any, found on the land.
