Mr. Abhishek Joshi, learned counsel for
the applicants.

2. Mr. Deepak Bisht, learned D.A.G. for the
State.

3. Present C-528 application is filed with
the prayer to set-aside/quash the chargesheet
dated 27.11.2022, cognizance/summoning
order dated 22.02.2023 passed by learned
Additional Chief Judicial Magistrate, Haldwani,
District Nainital in Criminal Case No. 927 of
2023, State Vs. Ajay Kumar and Others
,
under Sections 147, 148, 452, 323, 504 and
506 of IPC and the entire proceedings arising
out from it.

4. As per the averments made in the
complaint, it is alleged that brother of the
complainant was in love with daughter of one
Sanjay Pal, but, she was married to some
other person. From the complaint, it appears
that daughter of Sanjay Pal was not happy
with this marriage, therefore, after some time
of her marriage, she started residing with her
parents. As per the incident narrated in the
FIR, on 20.03.2022, the applicants called the
complainant’s family to their house, which is
in the same vicinity and there the applicants
pressurized the complainant and his family
members for marriage of her daughter with
complainant’s brother and also asked the
complainant to take their daughter with them
to their house. When refused, the applicants
physically assaulted the complainants.
Somehow they escaped from there, but, the
applicants trespass the house of the
complainant and severely beat them. As per
the FIR, in the incident, the complaint and his
father and mother suffered injuries.

5. Learned counsel for the applicants
submits that there is no medical certificate
enclosed either in the complaint or in the
chargesheet to prove the injuries; that
injuries, even if suffered by the complainants,
are simple in nature.

6. Having heard the submission, this Court
is of the view that this matter definitely
requires deliberation.

7. Issue notice to respondent no. 3. Steps
to be taken within a week.

8. List after service report is received.

9. In the meantime, counter-affidavit(s), if
any, be filed by the respondents.

10. After perusing the records and having
heard learned counsel for the parties, this
Court, prima facie, is of the opinion and is
satisfied that in the interest of justice, further
proceedings of Criminal Case No. 927 of 2023,
State Vs. Ajay Kumar and Others
, under
Sections 147, 148, 452, 323, 504 and 506 of
IPC, pending in the court of learned Additional
Chief Judicial Magistrate, Haldwani, District
Nainital, shall remain stayed qua the
applicants till the next date of listing.
