questions for consideration by the Larger Bench: –

“(i) Whether the law laid down by the learned
Division Bench in case of Pankaj Kumar (supra) and
Smt. Mosarrat Aara Khanam & Anr. (supra) is the
correct law or the judgments rendered by the learned
Division Bench in the cases of Binit Kumar (supra) and
Avinash Chakerworty & Anr. (supra) lay down the
correct law?

(ii) Whether in terms of the letter of the
Finance Department Dated 20.12.2000, the
compassionate appointees, like the petitioners, are
entitled to the pay scale of Rs.4000-6000/- or to the pay
scale of Rs.3050-4590/-, especially taking into account
the fact that they have been appointed after the cut-off
date, i.e., 20.12.2000?
