The complainant has filed the present complaint under
Section 200 of Cr.P.C. against the accused for the
commission of an offense punishable under section 138 of
Negotiable Instruments Act.
2. The case of the complainant in brief is as under:-
“The complainant submits that she and accused are
known to each other. In the month of October 2010,
accused had approached the complainant through broker
by expressing to sell the immovable property bearing
No.27/1, 170, 118/1, 118/2 situated at Valegarahalli
village, Bengaluru South Taluk. On 25.10.2017, the
complainant and accused have entered into an agreement to
sell for consideration amount of Rs.26,50,000/-. Thereafter
the complainant has paid amount on various dates. As per
agreement period for execution of sale deed was three
months. The accused has fails to perform his part of

contract by producing revenue documents. Thereafter on
consent of both the parties, they have extended time for
another 3 months. The accused has demanded further
advance amount of Rs.7 lakhs. Inspite of repeated requests
also the accused has fails to perform his part of contract
and complainant came to know that the accused has
already alienated his property to some other person. On
repeated requests, the accused had issued cheque bearing
No.408104, dated 10.03.2020 for a sum of Rs.12 lakhs
drawn on Vijaya Bank, Basaveshwaranagar branch,
Bengaluru. On presentation of said cheque through her
banker SBI Bank, Vijayanagar Branch, Bengaluru, same
has been dishonoured for the reason insufficient funds on
11.03.2020.
