01. By this petition filed under Article 226 of the Constitution of India,

petitioner-unit through its proprietor has challenged order Nos. 205

JK PCC of 2024 dated 16.10.2024, 181 JK PCC of 2024 dated

15.10.2024 and 220 JKPCC of 2024 dated 18.10.2024, issued by

respondent No. 2, whereby the petitioner has been directed to cease

the operation of the stone crusher. In terms of the said order,

respondent No. 2, has also directed the other respondents to take

further action against the unit of the petitioner as mentioned in the

impugned orders.

02. Learned counsel for the petitioner, at the outset, places reliance on an

order dated 10th July, 2024 passed by this Court in an identical matter

being WP(C) No. 1418/2024, submits that the case of the petitioner is

identical to the aforesaid case and, accordingly, prayed that the same

maintain parity.

03. Heard learned counsel for the petitioner and perused the material on

record.

04. Notice to the respondents returnable within three weeks. Requisites

within one week.

05. List on 03.04.2026.

06. In the meantime, subject to objections from other side and till next

date of hearing before the Bench, respondent No. 3 (Deputy

Commissioner Budgam) is directed to accord consideration to the

application filed by the petitioner for issuance of the NOC in terms of

SO/60 and applicable rules within three weeks from today. However,

it is made clear that till the application of the petitioner alleged to

have been pending before Deputy Commissioner Budgam, is not

decided by passing a speaking order, respondents shall not act upon

the impugned orders.
