[1] Present Mr. N. Jotendro, learned sr. counsel assisted by Md. Abdul
Baqee Khan, learned counsel for the petitioner, Mrs. Ch. Sundari, learned GA for
the State respondent nos. 1 & 2 and Mr. H. Chandrakumar, learned counsel along
with Mr. Changkhomba, learned counsel on behalf of the private respondent no.

[2] By the present writ petition, the petitioner who claims to be
Khullakpa of Charoichagotlong Village, Noney District (earlier Tamenglong
District) approached this Court challenging the impugned order dated
28.08.2012 issued by Addl. Chief Secretary (TA & Hills), Govt. of Manipur
declaring Shri Ningmei Kamei, private respondent no. 3 herein as Khullakpa cum
ex-officio Chairman of Charoichagotlong Part-II village, under Nungba Sub-
Division of Tamenglong District. It is submitted that the impugned order is in
violation of Section 3(4) of the Manipur (Village Authorities in Hill Areas) Act,
1956 and Section 29(ii) of the Manipur (Hill Areas) District Councils Act, 1971. It
is also prayed that the impugned order dated 28.08.2012 declaring the private
respondent no. 3 as Khullakpa be set aside as the same is in contravention of
existing Acts and Rules.
[3] Mr. N. Jotendro, learned sr. counsel for the petitioner submits
that the customary Court had already declared the petitioner as Khullakpa of the
amalgamated Charoichagotlong Part-I & II villages and the petitioner was
recognized as Khullakpa of the amalgamated Charoichagotlong village.
[4] Mrs. Ch. Sundari, learned GA has pointed out that the impugned
order dated 28.08.2012 is issued in pursuance to a meeting resolution of Kamei
Clan held on 25.10.2011 and 06.01.2012.
[5] Mr. H. Chandrakumar, learned counsel for the private respondent
no. 3 submits that the petitioner herein filed an Original Suit being O.S. No. 10
of 2014 against the private respondent no. 3 herein and another before the Court
of Ld. Civil Judge (Junior Division), Tamenglong inter-alia for declaring the
petitioner herein as Khullakpa of amalgamated Charoichagotlong village. Out of
the interim order passed by the Ld. Civil Judge, the matter reached up to this
Court by way of CRP(CRP ART. 227) No. 7 of 2016 and vide order dated
29.02.2016, the same was disposed of with an observation that the petitioner
did not act as Khullakpa for 38 years. It is submitted that the above mentioned
Original Suit is still pending.
[6] This Court is of the view that the plaint in the O.S. No. 10 of
2014 pending in the Ld. Civil Judge (Junior Division), Tamenglong will be relevant
for proper disposal of this writ petition. Accordingly, the petitioner is directed to
file a copy of the plaint O.S. No. 10 of 2014.
[7] Mr. N. Jotendro, learned sr. counsel for the petitioner submits
that he may be given some time to file available record of O.S. No. 10 of 2014.
