Environmental, Social & Governance Law 2022

Milbank LLP Environmental partner Matt Ahrens, Global Project, Energy & Infrastructure Finance partner Allan Marks and associates Allison Sloto (Environmental) and Pinky Mehta (Global Risk & National Security) recently co-authored a chapter titled “ESG Considerations in Project, Energy and Infrastructure Finance” in the International Comparative Legal Guide: Environmental, Social & Governance Law 2022, Second Edition. Global Corporate partners Iliana Ongun and Neil Whoriskey also contributed.

The chapter discusses how ESG considerations play an increasing role in project finance, affecting deal terms and risk assessment across energy and infrastructure sectors. With ESG at the forefront, investors, developers and governments are wrestling with the impacts of corporate activities on a wide range of stakeholders, including equity owners, customers, vendors, impacted communities, future generations, the environment and the planet. Given the increasing importance placed on ESG, the focus of each deal may need to go beyond the “bottom line” of short-term-profitability and shareholder return.

The article was first published in the ICLG – Environmental, Social, & Governance Law 2022.
