This is the turn before the Commissioner for cross-examination
of the witness of the plaintiff which is in progress.
The order of the Coordinate Bench dated September 15, 2025
shows that on the prayer of the learned Advocate appearing for the
defendant Nos. 1 to 4, since they intended to take inspection of the
document of the plaintiff, time was extended for taking inspection of the
document of the plaintiff by the defendant Nos. 1 to 4. Time to complete

commission was extended till December 11, 2025 for completion of the
examination of the first witness of the plaintiff and the Commissioner was
to file report before the Court on December 17, 2025.
On December 2, 2025 the defendants were granted further
liberty to take inspection of the document and it was directed that after
such inspection is over, the witness action shall commence before the
Commissioner within a week from the date of completion of inspection.
Time for completion of commission for the witness action was further
extended till February 27, 2026.
On January 16, 2026, by another order on the prayer of the
defendant Nos. 1 to 4, time to take inspection was further extended till
January 23, 2026 and the next date for commission was fixed on
January 27, 2026.
Today, the matter appears under the heading "To Be
Mentioned" when Mr. Partha Banerjee, learned Advocate appearing for
the defendant Nos. 1 to 4 submits that inspection of the document has
already been taken by the defendant Nos. 1 to 4.
Thus, it appears that there is no impediment to proceed with the
commission on the next date fixed i.e. February 24, 2026.
The record shows that sufficient opportunity has been granted to
the defendant Nos. 1 to 4 and now since, the inspection is completed, the
defendant Nos. 1 to 4 shall attend and proceed with the commission which
is scheduled on February 24, 2026.
It is noted that time to complete commission is still there till
February 27, 2026.

On the joint prayer of the parties, time is extended for completion
of commission till March 31, 2026.
If necessary, the learned Commissioner shall proceed to hold the
commission day to day basis.
Learned Commissioner shall file the report on the next day.

on April 8, 2026.
